{"id":191792,"date":"2008-08-21T00:00:00","date_gmt":"2008-08-20T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/tata-sky-and-another-vs-telecom-regulatory-authority-of-on-21-august-2008"},"modified":"2015-08-11T20:55:42","modified_gmt":"2015-08-11T15:25:42","slug":"tata-sky-and-another-vs-telecom-regulatory-authority-of-on-21-august-2008","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/tata-sky-and-another-vs-telecom-regulatory-authority-of-on-21-august-2008","title":{"rendered":"Tata Sky And Another vs Telecom Regulatory Authority Of &#8230; on 21 August, 2008"},"content":{"rendered":"<div class=\"docsource_main\">Punjab-Haryana High Court<\/div>\n<div class=\"doc_title\">Tata Sky And Another vs Telecom Regulatory Authority Of &#8230; on 21 August, 2008<\/div>\n<pre>CWP No. 16097 of 2007              (1)\n\n\nIN THE HIGH COURT OF PUNJAB &amp; HARYANA AT\nCHANDIGARH\n\n                             CWP No. 16097 of 2007\n                             Date of decision: August 21, 2008\n\n\n\nTata Sky and another                          ---   Petitioners\n\n\n           Versus\n\nTelecom Regulatory Authority of India and others\n                                             ---- Respondents\n\n\n\nCORAM: Hon'ble Mr. Justice Ashutosh Mohunta\n       Hon'ble Mr. Justice Rajan Gupta\n\nPresent:   Mr. Gopal Jain, Advocate, with\n           Mr. Akshay Bhan, Advocate,\n           for the petitioners.\n\n           Mr. Anil Rathee, Advocate, for\n           respondent No.1.\n           Mr. Ashok Aggarwal, Sr. Advocate, with\n           Mr. Manish Jain, Advocate, for\n           respondents No. 2 &amp; 3.\n           Mr. PS Thiara, Advocate, for\n           respondent No. 4.\n\n\nAshutosh Mohunta, J.\n<\/pre>\n<p>           This Court vide order dated March 11, 2008 directed the<br \/>\npetitioners to move an application with regard to price fixation before<br \/>\nthe Telecom Regulatory Authority of India ( for short &#8220;the TRAI&#8221;) and<br \/>\nthe same was to be decided within a period of eight weeks.\n<\/p>\n<p>           Counsel for the petitioners submits that       period of 8<br \/>\nweeks as granted by this Court has already expired, but no order<br \/>\nhas been passed by the TRAI.\n<\/p>\n<pre> CWP No. 16097 of 2007               (2)\n\n            Mr.    Rathee, counsel for the TRAI states that the\n<\/pre>\n<p>representation of the petitioners has been decided vide order dated<br \/>\nMay 12, 2008 and, therefore, no further orders are required to be<br \/>\npassed.\n<\/p>\n<p>            In reply to this submission, Mr. Jain learned counsel for<br \/>\nthe petitioners submits that the order dated May 12, 2008 was merely<br \/>\nrejection of the representation of the petitioners and not an order<br \/>\nregarding fixing of price within the meaning of Section 11(2) of the<br \/>\nTRAI Act, 1997 with regard to the price of the DTH Industry.\n<\/p>\n<p>            In this view of the matter, we direct the petitioners to file<br \/>\nfresh comprehensive representation before the TRAI within ten days<br \/>\nfrom today and an appropriate order, as envisaged under Section<br \/>\n11(2 )of the TRAI Act shall be passed by the competent authority<br \/>\nwithin a period of six weeks thereafter.
