SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 22\/06\/2010 \n\n \n\n \nORAL\nJUDGMENT<\/pre>\n<p>RULE.\n<\/p>\n<p>\tMr.Niraj Soni, learned Assistant<br \/>\n\tGovernment Pleader waives the service of notice of Rule on<br \/>\n\tbehalf of the respondent Nos.1 and 2 and Mr.Dhaval Nanavati, learned<br \/>\n\tadvocate waives the service of notice of Rule on<br \/>\n\tbehalf of the respondent No.3.\n<\/p>\n<p>With<br \/>\n\tthe consent of the learned advocates appearing on behalf of the<br \/>\n\trespective parties present application is taken up for final herein<br \/>\n\ttoday.\n<\/p>\n<p>Present<br \/>\n\tapplication under sec.5 of the Limitation Act has been preferred by<br \/>\n\tthe applicants herein   heirs and representatives of the original<br \/>\n\tpetitioner<br \/>\n\t No.1 of Special<br \/>\n\tCivil Application No. 30288 of 2007, to condone the<br \/>\n\tdelay of 368 days caused in preferring the application for bringing<br \/>\n\tthe heirs of the original petitioner<br \/>\n\t No.1 on record.\n<\/p>\n<p>Having<br \/>\n\theard the learned advocates appearing on behalf of the respective<br \/>\n\tparties and considering the fact that other co-owners of the<br \/>\n\tproperty in question are already on record, delay caused in<br \/>\n\tpreferring   the application for bringing the heirs of the original<br \/>\n\tpetitioner<br \/>\n\tNo.1 on record, is hereby condoned.
