Justice R.BASANT\n\n Dated :16\/09\/2008\n\n O R D E R\n                          R.BASANT, J.\n                       ----------------------\n                    Crl.M.C.No.3099 of 2008\n                   ----------------------------------------\n            Dated this the 16th day of September 2008\n\n                              O R D E R\n<\/pre>\n<p>     The petitioner and respondents 3 to 5 face indictment in a<\/p>\n<p>prosecution for the offence punishable under Section 380 read<\/p>\n<p>with 34 I.P.C. Cognizance has been taken on the basis of a final<\/p>\n<p>report submitted by the police.             The crux of the allegations<\/p>\n<p>against the accused persons is that they, in furtherance of their<\/p>\n<p>common intention, had stealthily removed a computer etc. from<\/p>\n<p>the premises of a private limited company.                   The de facto<\/p>\n<p>complainant is the second respondent who was one of the<\/p>\n<p>directors of the Company. While the matter is pending before<\/p>\n<p>the learned J.F.C.M-III, Thiruvananthapuram, the parties have<\/p>\n<p>settled their disputes.        The second respondent\/ de facto<\/p>\n<p>complainant has filed an affidavit also to report to the court that<\/p>\n<p>the disputes have been settled.\n<\/p>\n<p>     2. The dispute basically arose from internecine quarrel<\/p>\n<p>between the Directors and the employees. They have settled<\/p>\n<p>their disputes. Though the offence under Section 380 Cr.P.C is<\/p>\n<p>not legally compoundable, the learned counsel pray that invoking<\/p>\n<p>the extraordinary inherent jurisdiction under Section 482 Cr.P.C<\/p>\n<p>as enabled by the dictum in Madan Mohan Abbot v. State of<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.3099\/08                2<\/span><\/p>\n<p>Punjab [2008 AIR SCW 2287] premature termination of<\/p>\n<p>proceedings may be brought about. Ground realities may be<\/p>\n<p>taken into account. Waste of judicial time may be avoided. It<\/p>\n<p>may be noted that the dispute is one which is purely private and<\/p>\n<p>personal between the contestants and no issue of public policy or<\/p>\n<p>public interest is involved.\n<\/p>\n<p>      3.    Notice was given to the learned Public Prosecutor.<\/p>\n<p>The learned Public Prosecutor does not oppose the application.<\/p>\n<p>       4.   It is confirmed that there has been bona fide and<\/p>\n<p>genuine settlement of the disputes between the parties. I am<\/p>\n<p>satisfied that this is an eminently fit case where powers under<\/p>\n<p>Section 482 Cr.P.C, as enabled by the dictum in Madan Mohan<\/p>\n<p>(Supra) can be pressed into service.<\/p>\n<pre>\n\n      5.
