JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 29\/04\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tI<br \/>\nhave heard Mr.Mihir Joshi,learned Senior Advocate with<br \/>\nMr.S.N.Thakkar,learned advocate for the petitioners. It is submitted<br \/>\nby Mr.Mihir Joshi that respondents Nos.2 to 10, who are the original<br \/>\nland owners, entered into a transaction of sale of land bearing<br \/>\nSurvey No.847, admeasuring 20933 sq.yards situated in village<br \/>\nVejalpur, Taluka, City, District,sub-District   Ahmedabad (the Suit<br \/>\nland) with respondents Nos.11 and 12, on 5-12-1980, by two<br \/>\nRegistered Sale Deeds. Proceedings under Section 84-C of the Bombay<br \/>\nTenancy and Agricultural Lands Act,1948 ( The Tenancy Act  for<br \/>\nshort) were initiated for breach of the provisions of Section 63 of<br \/>\nthe Tenancy Act. By order dated 23-12-1987, the Mamlatdar held that<br \/>\nthere was no breach of the provisions of Section 63 of the Tenancy<br \/>\nAct, and the sale transactions were held to be valid. The order of<br \/>\nthe Mamlatdar was subjected to Suo Motu revision by the Deputy<br \/>\nCollector and by order dated 21-3-1989, the  Deputy Collector<br \/>\nconfirmed the order of the Mamlatdar.  Thereafter, on 25-4-1989,<br \/>\nrespondent No.12 sold the parcel of land purchased by her from the<br \/>\noriginal land owners to the petitioners, by way of a Registered Sale<br \/>\nDeed.  A Mutation Entry to this effect was mutated in the Revenue<br \/>\nRecords on 26-4-1989, which was certified on  31-5-1989. It is<br \/>\nfurther submitted by the learned Senior Advocate that after about<br \/>\nsixteen years, respondents Nos.2 to 10 (original land owners) filed a<br \/>\nRevision Application before the Gujarat Revenue Tribunal, ( The<br \/>\nTribunal  for short)  stating that on the date on which<br \/>\nrespondents Nos.11 and 12 had purchased the land from them, the said<br \/>\nrespondents were not agriculturists and, therefore, the sale<br \/>\ntransactions were illegal and invalid. The Tribunal, by order dated<br \/>\n8-8-2008, allowed the Revision Application filed by the original land<br \/>\nowners. The learned Senior Advocate has further contended that the<br \/>\nsaid order of the Tribunal has been passed without joining the<br \/>\npetitioners, who have purchased the land in question from respondent<br \/>\nNo.12, and are in open possession thereof from 1989. It is further<br \/>\nsubmitted that the Review Application filed by the petitioners for<br \/>\nre-call of the order dated 8-8-2008, on the ground that the<br \/>\npetitioners are affected parties and ought to have been heard before<br \/>\npassing the order, has been dismissed on various grounds which are<br \/>\nnot sustainable in law.\n<\/p>\n<p>\tThe<br \/>\nlearned Senior Advocate has placed reliance upon a judgment of this<br \/>\nCourt in A.B.Patel v. State of Gujarat, reported in 1999(2) GLH<br \/>\n314 in support of the proposition that the Tribunal has  power to<br \/>\n review procedural matters and can always correct palpable errors of<br \/>\nlaw in order to do substantial justice. It is further contended that<br \/>\nthe prayer of the petitioners that they have not been heard is<br \/>\nprocedural in nature, and in this view of the matter,it cannot be<br \/>\nsaid that the Review Application was not maintainable. It is further<br \/>\nsubmitted that in any case, the Tribunal has not held that the Review<br \/>\nApplication is not maintainable nor that it does not have the power<br \/>\nof review, but  the impugned order has been passed without<br \/>\nconsidering various vital aspects of the matter such as the fact that<br \/>\nthe Revision Application has been filed by the vendor of the land who<br \/>\nhas already pocketed the consideration and has no  locus standi, as<br \/>\nheld in Smt.Ratnaprabhabai v. Tulsidas V.Patel, reported in<br \/>\n1982(2) GLR 213. Further, it is emphasised by the learned Senior<br \/>\nAdvocate that in the impugned order,it has been  stated that the<br \/>\npetitioners are not parties to the  Revision Application, without<br \/>\nconsidering the fact that the original land owners have deliberately<br \/>\nnot joined them,  though they were aware that the land has been<br \/>\npurchased by the petitioners, regarding which Mutation entries  are<br \/>\nthere in the revenue record. It is forcefully  argued by the learned<br \/>\nSenior Advocate that the petitioners are vitally affected parties who<br \/>\nhave acquired certain vested rights in the property, and by<br \/>\ndismissing the Review Application filed by them, the Tribunal has<br \/>\ncommitted a serious error of law. It is,therefore, submitted by the<br \/>\nlearned Senior Advocate, that the petition be admitted and interim<br \/>\nrelief  granted.\n<\/p>\n<p>2.\tMr.K.V.Shelat,learned<br \/>\nadvocate for respondents Nos.2 to 10 (original land owners) has<br \/>\nopposed the admission of the petition and grant of interim relief, on<br \/>\nthe ground that the petitioners have stepped into the shoes of the<br \/>\nfirst purchasers  of the land (respondents Nos.11 and 12) who were<br \/>\nnot agriculturists on the date when the sale transaction took place,<br \/>\ntherefore,the petitioners cannot have a better title to the land than<br \/>\nthe persons from whom they have purchased it. It is further<br \/>\nsubmitted, that the Tribunal could not have entertained the Revision<br \/>\nApplication in view of the judgment of this Court in<br \/>\nSmt.Ratnaprabhabai v. Tulsidas V.Patel (Supra). The learned<br \/>\nadvocate for respondents Nos.2 to 10 has contended  that respondents<br \/>\nNos.11 and 12 have committed a fraud on the original land owners, as<br \/>\nwell as on the court, and that the petitioners do not have any locus<br \/>\nstandi to approach the Court.\n<\/p>\n<p>3.\tMr.Devan<br \/>\nParikh,learned advocate for respondents Nos.11 and 12 has supported<br \/>\nthe stand of the petitioners.\n<\/p>\n<p>4.\tMr.Jaswant<br \/>\nK.Shah,learned Assistant Government Pleader has submitted that the<br \/>\nState Government has not approached the Tribunal by way of Revision<br \/>\nand has brought to the notice of this Court judgment in Lalbhai<br \/>\nTrading Company v. Union of India, reported in  2006(1) GLR 497.\n<\/p>\n<p>5.\tI<br \/>\nhave heard the learned counsel for the respective parties and<br \/>\nconsidered the lengthy and elaborate submissions made by them.<br \/>\nSeveral issues of law have been raised, which require deeper<br \/>\nconsideration. Prima facie, the petitioners have made out a case for<br \/>\nadmission of the petition and grant of interim relief.\n<\/p>\n<p>6.\tIssue<br \/>\nRule, returnable on 26-7-2010.
