P.P.\n<\/p>\n<p>                                                  &#8212;&#8212;-\n<\/p>\n<p>3.   29.8.2011               Heard learned Counsel for the petitioner and the<\/p>\n<p>                 State.\n<\/p>\n<p>                            The petitioner seeks bail in a case instituted for the<\/p>\n<p>                 offence under Sections 341, 323, 324 and 302\/34 of the<\/p>\n<p>                 Indian Penal Code.\n<\/p>\n<p>                            Considering that the occurrence took place at the<\/p>\n<p>                 spur of the moment over cutting the wheat crops and there is<\/p>\n<p>                 a counter version of the occurrence and the petitioner is in<\/p>\n<p>                 custody since 29.5.2010 having no criminal antecedents, let<\/p>\n<p>                 the petitioner above named, be released on bail on furnishing<\/p>\n<p>                 bail bond of Rs. 5,000\/-(Five thousand) with two sureties of<\/p>\n<p>                 the like amount each or any other surety to be fixed by the<\/p>\n<p>                 court concerned to the satisfaction of learned Judicial<\/p>\n<p>                 Magistrate, Saran at Chapra in connection with Manjhi P.S.<\/p>\n<p>                 Case No.44 of 2010, subject to the conditions (i) That one of<\/p>\n<p>                 the bailor shall be Anil Kumar Singh, full brother of the<\/p>\n<p>                 petitioner and the other bailor will be a close relative of the<\/p>\n<p>                 petitioner who will give an affidavit giving genealogy as to how<\/p>\n<p>                 he is related with the petitioner. The bailor will undertake to<\/p>\n<p>                 furnish information to the Court about any change in address<br \/>\n<span class=\"hidden_text\">                                    -2-<\/span><\/p>\n<p>            of the petitioner. (ii) That the affidavit shall clearly state that<\/p>\n<p>            the petitioner is not an accused in any other case and if he is<\/p>\n<p>            he shall not be released on bail, (iii) That the bailor shall also<\/p>\n<p>            state on affidavit that he will inform the court concerned if the<\/p>\n<p>            petitioner is implicated in any other case of similar nature after<\/p>\n<p>            his release in the present case and thereafter the court below<\/p>\n<p>            will be at liberty to initiate the proceeding for cancellation of<\/p>\n<p>            bail on ground of misuse, (iv) That the petitioner will give an<\/p>\n<p>            undertaking that he will receive the police papers on the given<\/p>\n<p>            date and be present on date fixed for charge and if he fails to<\/p>\n<p>            do so on two given dates and delays the trial in any manner,<\/p>\n<p>            his bail will be liable to be cancelled for reasons of misuse, (v)<\/p>\n<p>            That the petitioner will be well represented on each date if he<\/p>\n<p>            fails to do so on two consecutive dates, his bail will be liable to<\/p>\n<p>            be cancelled.\n<\/p>\n<\/p>\n<pre>Narendra\/                        ( Anjana Prakash, J. )\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Sunil Singh vs The State Of Bihar on 29 August, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
