Judgment.\n<\/p>\n
            State of Haryana has filed this application under Section 378(3)<\/p>\n
Cr.P.C. with a prayer to grant leave to file an appeal against judgment and<\/p>\n
order dated September 25. 2008 and September 27, 2008, respectively, vide<\/p>\n
which the respondents were acquitted of the charge framed against them for<\/p>\n
commission of an offence under Section 307 IPC. However, they were<\/p>\n
convicted and sentenced for commission of offences punishable under<\/p>\n
Sections 148, 323, 325 read with Section 149 IPC.<\/p>\n
            It was allegation against the respondents that they in<\/p>\n
furtherance of their common object had caused injuries to Risal Singh<\/p>\n
(PW1). Regarding prosecution case, the trial Court has noticed the<\/p>\n
following facts:\n<\/p>\n

         “Shorn of unnecessary details, facts of prosecution case within<\/p>\n
         short compass are that on 05-08-2008, a telephonic message<\/p>\n
         was received from police post, General Hospital (GH), Bhiwani<\/p>\n
         about admission of injured Risal Singh son of Bhajju Singh,<\/p>\n
         Mohar Singh son of Risal Singh, Narain son of Godha Singh<\/p>\n
         and Harpal son of Hawa Singh in connection of some fight in<\/p>\n
         between them. Assistant Sub Inspector (ASI) Mukhtiar Singh,<\/p>\n
         Investigating Officer (I.O) went to Civil Hospital, Bhiwani and<\/p>\n
         collected a rukka Ex. PO13 and Medico legal reports (MLRs)<\/p>\n
         of injured. He moved application Ex. P14 before doctor to<\/p>\n
         report about fitness of Risal Singh to make statement but he<\/p>\n
         was declared unfit to make statement. On 06-08-2006, he was<\/p>\n
         declared fit to make statement on that very application, so his<\/p>\n
         statement Ex. P01 was recorded, wherein it was stated by him<\/p>\n
         that on 05-08-2006, at about 6.00 p.m. He was sitting in front<\/p>\n
         of his shop. In the mean time, a vehicle make Sumo being<\/p>\n
         driven by accused Narain Singh stopped in front of his shop.<\/p>\n
         Accused Sadhu, Narain Singh, Balbir, Santu and Harpal<\/p>\n
         alighted from the same. Firstly, accused Narain Singh came and<\/p>\n
         caused injuries in between fingers of his left hand with knife.<\/p>\n
         Thereafter, Santu and Sadhu armed with ‘dandas’ (sticks)<\/p>\n
         caused injuries on his waist and chin. Surender armed with<\/p>\n
         danda caused injury on his waist. In the mean time, Balbir<\/p>\n
         armed with danda came running and gave push blow on his left<\/p>\n
         side. Thereafter, Ajit son of Balbir came running and started<\/p>\n
         giving slap and fist blows. An other son of Balbir, whose name

             was not known to him, started giving kick and fist blows to<\/p>\n
             him. Sandeep son of Narain Singh also gave slap and fist blows<\/p>\n
             to him. Harpal son of Jagdish and nephew of Narain Singh also<\/p>\n
             came running. He was having hockey in his hand and gave<\/p>\n
             blow to him. On hearing noise, his son Mohar Singh came to<\/p>\n
             spot and accused also caused injuries to him. On hearing their<\/p>\n
             noise, his grand sons Amar son of Bir Singh, Deepak son of<\/p>\n
             Mahender Singh and Jittu son of Mohar Singh came to spot.<\/p>\n
             They rescued them from clutches of accused otherwise they<\/p>\n
             would have caused more injuries. Accused caused injuries<\/p>\n
             because a dispute was going on in between them since 10\/ 12<\/p>\n
             years about land.”\n<\/p><\/blockquote>\n

             On receipt of intimation, initially, DDR was recorded.<\/p>\n<\/blockquote>\n
However, subsequent thereto, FIR No. 167 dated August 11, 2006, was<\/p>\n
registered against the respondents for commission of offences under<\/p>\n
Sections 148, 323, 325\/ 149 IPC. On getting opinion of the Medical Board<\/p>\n
on October 23, 2006, offence punishable under Section 307 IPC was also<\/p>\n
added in the FIR. After completing necessary investigation, final report was<\/p>\n
put in Court for trial.\n<\/p>\n
             The prosecution produced 13 witnesses and also brought on<\/p>\n
record documentary evidence to prove its case. On conclusion of<\/p>\n
prosecution evidence, statements of the respondents were recorded under<\/p>\n
Section 313 Cr.P.C. Incriminating material was put to them. They denied<\/p>\n
the same and claimed false implication. They also led evidence in defence.<\/p>\n
The trial Court on appraisal of evidence acquitted them, so far as charge

under Section 307 IPC is concerned. However, they were convicted and<\/p>\n
sentenced for other minor offences. Hence this application. While acquitting<\/p>\n
them for commission of offence under Section 307 IPC, the trial Court has<\/p>\n
observed as under:\n<\/p>\n
            “To prove an offence punishable under section 307 of IPC,<\/p>\n
            prosecution is supposed to show that a person did an act with<\/p>\n
            such intention or knowledge that said act can cause death. An<\/p>\n
            intention of an accused to cause death is must. In the present<\/p>\n
            case, injuries were not on vital parts of body of Risal Singh. As<\/p>\n
            per statement of PW.04, injuries were on non-vital parts. As per<\/p>\n
            opinion of PW.03, it cannot be presumed that injuries were<\/p>\n
            dangerous to life. It was nowhere stated by him that said injury<\/p>\n
            was sufficient to cause death in ordinary course of nature.<\/p>\n
            Unless it is proved by prosecution that injury was sufficient to<\/p>\n
            cause death in ordinary course of nature, section 307 IPC is not<\/p>\n
            attracted. PW.10 gave treatment to Risal Singh but he nowhere<\/p>\n
            stated that injury was dangerous to life. Prosecution was<\/p>\n
            supposed to ask him about nature of injury. Further, PW.07 did<\/p>\n
            not conduct X-ray examination of Risal Singh. As per her<\/p>\n
            statement, report Ex. P10 was given by doctor Satish. She was<\/p>\n
            not in a position to tell that how this fracture can occur.<\/p>\n
            However, PW.08 and PW.10 admitted in their cross<\/p>\n
            examination that as Risal Singh was very old, so possibility of<\/p>\n
            this fracture by fall could not be ruled out. It is alleged by<\/p>\n
            accused that when PW.01 and PW.02 went to take possession<\/p>\n
            of land illegally, PW.01 fell on sticks and got his ribs fractured.

            More so, as per statement of PW.10 , there was fracture of ribs<\/p>\n
            on left side but PW.09 stated that three ribs of right side were<\/p>\n
            fractured. If there were fractures on right side also then why<\/p>\n
            PW.10 did not state to that effect. As per report, there was<\/p>\n
            fracture of left ribs. As per statement of PW.09, fracture of right<\/p>\n
            ribs was about 21 days old. It shows that ribs of Risal Singh<\/p>\n
            were fractured much before 05.08.2006. It was stated by Risal<\/p>\n
            Singh in his statement Ex. P01 that push blows were given on<\/p>\n
            his left side but when he entered witness box as PW.01, it was<\/p>\n
            stated by him that thrust blows were given on right side. He has<\/p>\n
            changed his statement just to cover up statement of PW.09<\/p>\n
            because he stated about fracture of right ribs whereas treatment<\/p>\n
            was given about fracture of left ribs. In these circumstances, it<\/p>\n
            cannot be presumed that a case punishable under section 307 of<\/p>\n
            IPC is made out. At the most, it can be presumed that a case<\/p>\n
            punishable under Section 325 of IPC is made out because this<\/p>\n
            injury is covered by section 320 of IPC.”<\/p><\/blockquote>\n
            We are of the opinion that the finding given by the trial Court is<\/p>\n
perfectly justified and is as per evidence on record. Admittedly, except one,<\/p>\n
other accused were armed with wooden sticks only. Had their intention been<\/p>\n
to kill Risal Singh, they would have come fully armed with deadly weapons.<\/p>\n
It is also not in dispute that injuries were also received by some of the<\/p>\n
respondents at the time of alleged occurrence. The trial Court has also<\/p>\n
noticed discrepancies in the medical statement regarding, fatal injury to<\/p>\n
Risal Singh, which resulted into adding of Section 307 IPC in the FIR.

Counsel for the applicant has failed to indicate any misreading of evidence<\/p>\n
by the trial Court, on the basis of which any interference can be made by us.<\/p>\n
            Their Lordships of the Supreme Court in Allarakha K. Mansuri<\/p>\n
v. State of Gujarat,<\/a> 2002 (1) RCR (Criminal) page 748, held that where, in a<\/p>\n
case, two views are possible, the one which favours the accused has to be<\/p>\n
adopted by the Court.\n<\/p>\n
            A Division Bench of this Court in State of Punjab v. Hansa<\/p>\n
Singh,<\/a> 2001(1) RCR (Criminal) page 775, while dealing with an appeal<\/p>\n
against acquittal, has opined as under:-\n<\/p>\n
            “We are of the opinion that the matter would have to be<\/p>\n
            examined in the light of the observations of the Hon’ble<\/p>\n
            Supreme Court in Ashok Kumar v. State of Rajasthan, 1991(1)<\/p>\n
            SCC 166, which are that interference in an appeal against<\/p>\n
            acquittal would be called for only if the judgment under appeal<\/p>\n
            were perverse or based on a mis-reading of the evidence and<\/p>\n
            merely because the appellate Court was inclined to take a<\/p>\n
            different view, could not be a reason calling for interference.”<\/p><\/blockquote>\n
            Counsel for the State has failed to show that the trial Court has<\/p>\n
committed any error on facts or material irregularity, which may necessitate<\/p>\n
any interference by this Court.\n<\/p>\n
            For the reasons, mentioned above, this application fails and the<\/p>\n
same is accordingly dismissed.\n<\/p>\n
