ASHOKBHAI LAKHARA &amp; 2 - Defendant(s)\n \n\n=========================================================\n \nAppearance\n: \nMR\nGC MAZMUDAR for\nAppellant(s):1,MR HG MAZMUDAR for Appellant(s):1, \nNone for\nDefendant(s) : 1, \nMR SK BUKHARI for Defendant(s) : 1.2.1, 1.2.2,\n1.2.3, 1.2.4,1.2.5  \nRULE NOT RECD BACK for Defendant(s) : 2 -\n3. \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE H.K.RATHOD\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 18\/07\/2008 \n\n \n\nORAL\nORDER<\/pre>\n<p>\tRespondents<br \/>\nNo.2 and 3 \u00fd  Driver and Owner are not served, but, learned advocate<br \/>\nMr. Bukhari is appearing on behalf of respondent claimant.\n<\/p>\n<p>\tHeard<br \/>\nlearned advocate Mr. Mazmudar appearing on behalf of appellant.\n<\/p>\n<p>\tThis<br \/>\nCourt has admitted the appeal on 13th December 2007 and on<br \/>\nthe same day, in stay application, rule is made returnable on 29th<br \/>\nJanuary 2008 as well as ad-interim relief in terms of Para 8A was<br \/>\ngranted on condition to deposit the awarded amount before the Claims<br \/>\nTribunal.\n<\/p>\n<p>\tLearned<br \/>\nadvocate Mr. Mazmudar submitted that as per directions issued by this<br \/>\nCourt, the amount of Rs.3,49,665\/- is deposited by the insurance<br \/>\ncompany before the Claims Tribunal excluding Rs.25,000\/- which is<br \/>\ntransmitted from this Court to Claims Tribunal.\n<\/p>\n<p>\tTherefore,<br \/>\nclaimants now are representing in the appeal, the question of service<br \/>\nto the owner and driver are to be avoided.\n<\/p>\n<p>\tTherefore,<br \/>\nit is directed to Tribunal to disburse 40% amount, from the deposited<br \/>\namount by the Insurance Company, in favour of respondent claimant by<br \/>\naccount payee cheque. Rest of 60% amount is to be invested in any<br \/>\nnationalised bank initially for a period of five years with<br \/>\ncumulative interest by periodical renewal till the appeal is finally<br \/>\ndecided by this Court.\n<\/p>\n<p>\tThe<br \/>\nclaimants are not entitled any amount of interest from the said FDR.<br \/>\nThe FDR is in the name of claimant to be remained with Nazir of the<br \/>\nconcerned Tribunal.\n<\/p>\n<p>\tLearned<br \/>\nadvocate Mr. Mazmudar submitted that Civil Application is filed for<br \/>\nsubstitute the service to the respondents No.2 and 3, therefore,<br \/>\nregistry is directed to circulate Civil Application on 22nd<br \/>\nJunly 2008 along with the present appeal.\n<\/p>\n<p>\tAccordingly,<br \/>\nmatter is adjourned to 22nd July 2008.\n<\/p>\n<p>[H.K.
