A Pasayat<\/div>\n<div class=\"doc_bench\">Bench: Dr. Arijit Pasayat, Lokeshwar Singh Panta<\/div>\n<pre>           CASE NO.:\nAppeal (civil)  4307 of 2007\n\nPETITIONER:\nRajeev Hitendra Pathan &amp; Ors\n\nRESPONDENT:\nAchyut Kashinath Karekar &amp; Anr\n\nDATE OF JUDGMENT: 17\/09\/2007\n\nBENCH:\nDr. ARIJIT PASAYAT &amp; LOKESHWAR SINGH PANTA\n\nJUDGMENT:\n<\/pre>\n<p>J U D G M E N T<\/p>\n<p>CIVIL APPEAL NO.\t4307 OF 2007<br \/>\n(Arising out of SLP (C) No. 2967 of 2006)<\/p>\n<p>Dr. ARIJIT PASAYAT, J.\n<\/p>\n<p>1.\tLeave granted.\n<\/p>\n<p>2.\tChallenge in this appeal is to the order passed by the<br \/>\nNational Consumer Disputes Redressal Commission, New<br \/>\nDelhi (in short &#8216;National Commission&#8217;) holding that the State<br \/>\nCommission has the power to restore the complaint which was<br \/>\ndismissed for default. For coming to the aforesaid conclusion<br \/>\nthe National Commission relied upon the decision of this<br \/>\nCourt in <a href=\"\/doc\/1106770\/\">New India Assurance Co. Ltd. v. R. Srinivasan<\/a> (2000<br \/>\n(3) SCC 242).\n<\/p>\n<p>3.\tLearned counsel for the appellant submitted that the<br \/>\nview contrary to what has been stated in New India<br \/>\nAssurance&#8217;s case (supra) has been taken in <a href=\"\/doc\/1119082\/\">Jyotsana<br \/>\nArvindkumar Shah and Ors. v. Bombay Hospital Trust<\/a> (1999<br \/>\n(4) SCC 325). Further, Consumer Protection Act, 1986 (in<br \/>\nshort the &#8216;Act&#8217;) was amended in 2003 and by the newly<br \/>\nintroduced Section 22A, National Commission was given<br \/>\npower of restoration but no such power has been conferred on<br \/>\nthe State Commission.\n<\/p>\n<p>4.\tLearned Counsel for the respondents on the other hand<br \/>\nsubmitted that the National Commission has referred the case<br \/>\nto the factual position and, therefore, held that restoration was<br \/>\npermissible.\n<\/p>\n<p>5.\tIn Jyotsana&#8217;s case (supra) it was observed at para 7 as<br \/>\nfollows:\n<\/p>\n<p>&#8220;We heard learned Counsel on both sides for<br \/>\nquite some time. When we asked the learned<br \/>\nCounsel appearing for the respondent to point<br \/>\nout the provision in the Act which enables the<br \/>\nState Commission to set aside the reasoned<br \/>\norder passed, though ex parte, he could not lay<br \/>\nhis hands on any of the provisions in the Act.<br \/>\nAs a matter of fact, before the State<br \/>\nCommission the appellants brought to its<br \/>\nnotice the two orders, one passed by the Bihar<br \/>\nState Commission in Chief Manager, UCO<br \/>\nBank v. Ram Govind Agarwal 1996 (1) CPR<br \/>\n351 and the other passed by the National<br \/>\nCommission in Director, Forest Research<br \/>\nInstitute v. Sunshine Enterprises 1997 (1) CPR<br \/>\n42 holding that the redressal agencies have no<br \/>\npower to recall or review their ex parte order.<br \/>\nThe State Commission had distinguished the<br \/>\nabove said orders on the ground that in those<br \/>\ntwo cases the opponents had not only not<br \/>\nappeared but also failed to put in their written<br \/>\nstatements. In other words, in the case on<br \/>\nhand, according to the State Commission, the<br \/>\nopponent (respondent) having filed the written<br \/>\nstatements, the failure to consider the same by<br \/>\nthe State Commission before passing the order<br \/>\nwould be a valid ground for setting aside the<br \/>\nex parte order. The State Commission,<br \/>\nhowever, fell into an error in not bearing in<br \/>\nmind that the Act under which it is functioning<br \/>\nhas not provided it with any jurisdiction to set<br \/>\naside the ex parte reasoned order. It is also<br \/>\nseen from the order of the State Commission<br \/>\nthat it was influenced by the concluding<br \/>\nportion of the judgment of the Bombay High<br \/>\nCourt to the effect that the respondent (writ<br \/>\npetitioner) could approach the appellate<br \/>\nauthority or make an appropriate application<br \/>\nbefore the State Commission for setting aside<br \/>\nthe ex parte order, if permissible under the<br \/>\nlaw. Here again, the State Commission failed<br \/>\nto appreciate that the observation of the High<br \/>\nCourt would help the respondent, if<br \/>\npermissible under the law. If the law does not<br \/>\npermit the respondent to move the application<br \/>\nfor setting aside the ex parte order, which<br \/>\nappears to be the position, the order of the<br \/>\nState Commission setting aside the ex parte<br \/>\norder cannot be sustained. As stated earlier,<br \/>\nthere is no dispute that there is no provision in<br \/>\nthe Act enabling the State Commission to set<br \/>\naside an ex parte order.&#8221;\n<\/p>\n<p>6.\tSubsequently, in New India Assurance&#8217;s case (supra) this<br \/>\nCourt appears to have taken a different view as it is evident<br \/>\nfrom what has been stated in paragraph 18, the same reads as<br \/>\nfollows:\n<\/p>\n<p>&#8220;We only intend to invoke the spirit of the<br \/>\nprinciple behind the above dictum in support<br \/>\nof our view that every court or judicial body or<br \/>\nauthority, which has a duty to decide a lis<br \/>\nbetween two parties, inherently possesses the<br \/>\npower to dismiss a case in default.  Where a<br \/>\ncase is called up for hearing and the party is<br \/>\nnot present, the court or the judicial or quasi<br \/>\njudicial body is under no obligation to keep the<br \/>\nmatter pending before it or to pursue the<br \/>\nmatter on behalf of the complainant who had<br \/>\ninstituted the proceedings. That is not the<br \/>\nfunction of the court or, for that matter of a<br \/>\njudicial or quasi judicial body.  In the absence<br \/>\nof the complainant, therefore, the court will be<br \/>\nwell within its jurisdiction to dismiss the<br \/>\ncomplaint, for non-prosecution.  So also, it<br \/>\nwould have the inherent power and<br \/>\njurisdiction to restore the complaint on good<br \/>\ncause being shown for the non-appearance of<br \/>\nthe complainant.&#8221;\n<\/p>\n<p>7.\tIn the latter case i.e. New India Assurance&#8217;s case (supra)<br \/>\nreference was not made to the earlier decision in Jyotsana&#8217;s<br \/>\ncase (supra).  Further the effect of the amendment to the Act<br \/>\nin 2003 whereby Section 22(A) was introduced has the effect of<br \/>\nconferment of power of restoration on National Commission,<br \/>\nbut not to the State Commission. In view of the divergence of<br \/>\nviews expressed by coordinate Benches, we refer the matter to<br \/>\na larger Bench to consider the question whether the State<br \/>\nCommission has the power to recall the ex parte order.<br \/>\nRecords be placed before the Hon&#8217;ble Chief Justice of India for<br \/>\nappropriate orders.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Rajeev Hitendra Pathan &amp; Ors vs Achyut Kashinath Karekar &amp; Anr on 17 September, 2007 Author: .
