KRISHNAN, J.\n                    ...........................................\n                     M.A.C.A.NO.955 OF 2010\n                   .............................................\n           Dated this the 7th day of December, 2010.\n\n                          J U D G M E N T\n<\/pre>\n<p>      This is an appeal preferred against the award of the<\/p>\n<p>Claims Tribunal, Mavelikara in O.P.(MV)No.1886\/1999. The<\/p>\n<p>claimant sustained injuries in an accident and he has been<\/p>\n<p>awarded a compensation of Rs.61,660\/= with 7.5% interest.<\/p>\n<p>The third respondent was directed to pay the amount and<\/p>\n<p>get it reimbursed from the second respondent in the claim<\/p>\n<p>petition, who is the owner, as the driver has driven the<\/p>\n<p>vehicle without valid driving licence.                     It is challenging the<\/p>\n<p>same, the owner has come up in appeal.\n<\/p>\n<p>      2. Heard the learned counsel for the appellant as well as<\/p>\n<p>the respondents. The case attempted to be projected in the<\/p>\n<p>appeal is that the owner had entrusted                          the vehicle to a<\/p>\n<p>workshop and somebody from the workshop had driven the<\/p>\n<p>vehicle and that resulted in the accident.                       It is contended<\/p>\n<p>that   there is no authorisation for the driver to drive the<\/p>\n<p>vehicle.\n<\/p>\n<p>      I feel a totally different approach is taken in the appeal<\/p>\n<p>and it is    totally     against          the pleadings in the written<\/p>\n<p><span class=\"hidden_text\">                              : 2 :<\/span><br \/>\nM.A.C.A.NO.955 OF 2010<\/p>\n<p>statement filed before the Tribunal. I had the opportunity to<\/p>\n<p>peruse the    written statement     filed before the Tribunal.<\/p>\n<p>What is stated therein is that the first respondent did have a<\/p>\n<p>valid driving licence and he had driven the vehicle with due<\/p>\n<p>care and it was on account of the negligence of the claimant,<\/p>\n<p>the accident took place. The second respondent also admits<\/p>\n<p>his ownership over the vehicle and says that it has been<\/p>\n<p>insured with the insurance company. There is absolutely no<\/p>\n<p>whisper regarding entrustment of the vehicle            to the<\/p>\n<p>workshop or a case that some unauthorised person had<\/p>\n<p>driven the vehicle in order to cause the accident. No party<\/p>\n<p>can be permitted to travel beyond the pleadings and if such<\/p>\n<p>type of contentions are entertained in the appeal, it will<\/p>\n<p>result in miscarriage of justice and therefore the new<\/p>\n<p>contention attempted to be raised in the Memorandum of<\/p>\n<p>Appeal is really to be deprecated and it shall not be accepted.<\/p>\n<p>When it is so, the finding of the Tribunal makes it very<\/p>\n<p>clear that how the accident took place, who was negligent<\/p>\n<p>and that the driver did not have the valid driving licence.<\/p>\n<p>The Tribunal has granted a recovery right and nothing else.<\/p>\n<p><span class=\"hidden_text\">                                 : 3 :<\/span><br \/>\nM.A.C.A.NO.955 OF 2010<\/p>\n<p>It is perfectly justified in law.\n<\/p>\n<p>        Therefore, I do not find any merit in the appeal. So<\/p>\n<p>the appeal fails and the same is dismissed.<\/p>\n<p>                                      M.N.
