This appeal coming on for admission; this  the  ._<\/p>\n

JUDGMENT’ _<\/p>\n
1. This is an appeal  Irisuranee’i\u00e9ompanviriAchallenging<\/p>\n
the award passed by   Workmen’s<\/p>\n

compensation: in  \/4 along with interest at<\/p>\n
12% pa with ‘effeet  “of expiry of 30 days from the<\/p>\n
date of death’;,__’ ”\n<\/p>\n
 Claimant-respondent being the mother of the deceased<\/p>\n
A\ufb02rnmired _g the Clainis Tribunal seeking compensation contending<\/p>\n
interalia that’v_vo_n’V~i.:i’2.i01.200′? when her son was discharging his<\/p>\n
V .duties.”as ‘cleaner under the 2nd respondent, due to an<\/p>\n
.,”\u00a2A”‘–a\u00a7;’cidVaent that arose out of and during the course of<\/p>\n
 employment, he suffered serious injuries resulting in his death.<\/p>\n

The claimant examined herself and deposed that her son was<\/p>\n
earning Rs.-4,500\/– as a cleaner. She relied on <\/p>\n
Ex.P.8. The respondentminsurance Company  i.<\/p>\n
claim denying the assertions. I  _<\/p>\n
3. Based on the evidence on recorci, the Cominvissioneriii’has.y<\/p>\n
recorded a \ufb01nding that the  was earning \/– ” S<\/p>\n
p.m. as a cleaner. The age of th\u20ac;r.deiceased was foundito be 20
\nyears at the time of   .:the_relevant factor
\nnamely 224.00, coii1pensatio’r1 Rs.4,48,000\/-

\ninterest  ,   V. , <\/p>\n
4. Learned’  appellant contends that there<\/p>\n
was violation.eofithe”–permi.t ‘conditions inasmuch as the owner<\/p>\n

i?_Prad.e_sh  the accident in question occurred while the<\/p>\n
viehici-“e__ voperated beyond the jurisdiction of the State<\/p>\n
i ii of Kar’nata_ka.._’Et is his next contention that the income taken<\/p>\n

opposed to the principles laid down in the judgment<\/p>\n
by the Apex Court in the case of ORIENTAL .<\/p>\n

6. Having heard the learned  parties and on
\nperusal of the rnater__ials ;on” that there is no<\/p>\n
substance in urged’  thewappellant regarding<\/p>\n
the violation  l’permit:i.cond’itions.  of all, there is no such
\nplea takenirl the vxrilttenstaterrient. Unless a specific plea is<\/p>\n
raised, no arnount of. evidence adduced on this aspect will come<\/p>\n
‘lite-..the-help’-iof the appveilant-Insurance Company. Secondly, as<\/p>\n
per “”.:li1_e’sproyisionvs”‘contained under Section 88 of the Motor<\/p>\n
‘   Vehicles  a perusal ‘of the second proviso appended<\/p>\n
 topsub section 1 of Section 88 would disclose that where both<\/p>\n
   starting point and the terminal point of a route are situate<\/p>\n
 ___”Witl?i;in the same State, but part of such route lies in any other<\/p>\n

State and the length of such part does not exceed sixteen<\/p>\n
kilometres, the permit shall be valid in the other ..St.a’tei*-ri,n<\/p>\n
respect of that part of the route which is in that ~<\/p>\n
notwithstanding that such permit has not beerniict\ufb02ntersigned <\/p>\n
by the State Transport authority or’-._thr_.:”‘eRiegi’onal:i’Tran’spott’<\/p>\n

Hence, iethe”‘”\ufb01Vrst contention urged is liable to be<\/p>\n
r’e_iet:ted’.a.\n<\/p>\n
Z  ‘7. A  se.cond: contention pertaining to the wages earned by<\/p>\n
 ~._th.e deceased cannot also be sustained as the evidence on<\/p>\n
it  record discloses that the deceased was engaged as a cleaner in<\/p>\n
  lorry. The assertion of the claimant is that the deceased<\/p>\n

was earning Rs.4,500\/- per month. No documentary evidence<\/p>\n
can be expected from a cleaner for receiving <\/p>\n
Therefore, the Commissioner has recorded his \ufb01nd_i–n.g  ~<\/p>\n
the oral evidence adduced before  Tiftel”‘aclc,idei1tv”has <\/p>\n
occurred in the year 2007. The dec’ease’de <\/p>\n
cleaner in a lorry in Bellaryi in connection 7VVvvi..ti:..,_,,mining , *<\/p>\n
operations. Hence, it cannot be .that_ythe fearningsvitaken at
\nRs.4,000\/- per month is  _ if if<\/p>\n
8. As regards the last  the appellant
\nis justified  at 12% p.a.
\nwith effect 1ttetri..f\u00a2-eepity, the date of death is
\nnot legallliancll  judgment of the Apex Court<\/p>\n
referred to slupra_mal,<es. i't.c,iear that for the period from the<\/p>\n
4_ , date o\ufb01petition till" expiry of 30 days from the date of the<\/p>\n
IA'~.order,,interest–at\u00bb.7V2 "\/0 p.a. could be granted and for the rest of<\/p>\n
the .periodV,"statu't'o'ry interest at 12% p.a. has to be awarded.<\/p>\n
 _   Accordingly to the aforesaid extent, the award deserves to<\/p>\n
  fnodi\ufb01ed. Hence, this appeal is allowed in part. While<\/p>\n
 .___"ConfI:rming the amount determined as compensation payable,<\/p>\n
it<\/p>\n

the interest awarded is modi\ufb01ed making it clear that the<\/p>\n
claimant is entitled to interest at 7'\/2% from the date of petition<\/p>\n
till 18.12.2008 and thereafter at the rate of 12%; _<\/p>\n
