This appeal by the appe11a.nt–I\u00bbnsurer:i’s”a.i’isif1g ‘out__ <\/p>\n
of the impugned judgment and it<\/p>\n
passed in MVC No. 84\/2GO4.*bjr__. thedikiifieipai”t?iyii_iJtJdgei<\/p>\n
(Sr. Dn) and CJM and Motor Tigibunai,
\nMandya, {hereinafter  tofasi. for\n<\/p>\n
2. The Tribiinal   award has
\nawarded a sung”  ‘id..ifte’rent heads with

\nSri. Shankari,iii:1_V_:thVeVtoad traffic accident.
\n  brief,  of the Case are:\n<\/p>\n
i    of the accident and resultant<\/p>\n
death ofvthegdeeeased Sri. Shankar are not in dispute.<\/p>\n
‘}3’urthei*,___it is also not in dispute that, ciaimants being<\/p>\n
 pi.ithe.pjare11ts, wife and Children of the deceased have<\/p>\n
ii   fiied a claim petition before the Tribunal under section<\/p>\n
166 of MV Act, claiming compensation against the
\nowner, insurer and driver of the offending vehicle. The
\nsaid ciaim petition had come up for consideration before<\/p>\n
the Tribunal. The Tribunal in turn, after assessinghhithe<\/p>\n
oral and documentary evidence, has allowed  <\/p>\n
petition in part and awarded a sum <\/p>\n
under different heads with interest a:t,.i6%ii’p.a,A; <\/p>\n
date of petition till the date-.__of deposit, fastening
\nliability on the Insurer. Being.i.:iaggrieiVed:iby  said
\njudgment and awardV,”\u00ab–theAins;;.1rer._’ha’spresented this<\/p>\n
appeal,”Heontehdirigs’that; fastening the liability on it
\nC8.I11’10t’ii}\u20ac ‘sustainiejd_:’anid~.is~ liable to be set aside on the<\/p>\n
grounds that;’ _dur.ir:gi”the”‘:pendency of this appeal, the<\/p>\n
“~v_app1.ieati-on \ufb01led by”ti'”1’eVInsurer for production of insurance<\/p>\n
  not been produced before the Tribunal<\/p>\n
in.adVertei\u00a7ti3I_ and due to communication gap between the<\/p>\n
yginsurerv and the counsel who represented the Insurer, as<\/p>\n
i,._”‘addii’ti.ona1 document has been allowed by this Court and<\/p>\n
therefore, the matter requires reconsideration afresh.<\/p>\n
e. We have heard the learned counsel for the insurer<\/p>\n
and learned eounsei for claimants at considerable Ee4n.gt-h_ef<\/p>\n
time.\n<\/p>\n
5. After careful gerusat of the material av’ail–:a.b~1elbn file,__ it<\/p>\n
including the impugned judgment   .l<\/p>\n
Tribunal, it emerges that, in’ -fact,
\nproduced the copy of the  belfere the
\nTribunal. During   the
\napplication filed  the   of copy of
\nthe Insurance:    document has
\nbeen {nae gate dated 25.5.2010.\n<\/p>\n
It is the  learned counsel for the<\/p>\n
lnsurer th’at,= the  question was insured by<\/p>\n
 one Ziiauilae-alslonithe date of the accident and not<\/p>\n
  as contended by the claimants. The fact<\/p>\n
asAlto,’wihelt’l<z.eij;.the said vehicle has been transferred to<\/p>\n
'V the sl'ubseqiilent purchaserw cum\u00bb owner Sri. Kurnar has<\/p>\n
 lfto be decided by the Tribunal and for that, it requires<\/p>\n
 additional oral and documentary evidence and on the<\/p>\n

basis of which, the Tribunal has to decide the liability.<\/p>\n
Taking all these factors into consideration, wit1F*io’1it<\/p>\n
going further into the merits and demerits of  <\/p>\n
and to safeguard the interest of both  <\/p>\n
would suffice for this Court  <\/p>\n
