Justice S.S.SATHEESACHANDRAN\n\n Dated :15\/07\/2009\n\n O R D E R\n            S.S.SATHEESACHANDRAN, J.\n            ------------------------\n     C.R.P Nos.693 OF 2008 AND 326 OF 2008\n     -------------------------------------\n      Dated this the 15th day of July 2009\n        ---------------------------------\n\n\n                     O R D E R\n<\/pre>\n<p>        These  two   revisions  have   been   filed<\/p>\n<p>against the order dated 09\/01\/2007 passed by the<\/p>\n<p>Additional District Judge, Palakkad in a petition<\/p>\n<p>filed under Section 51 of the Indian Electricity<\/p>\n<p>Act and Section 10 and 16 of the Telegraph Act for<\/p>\n<p>enhanced compensation for the cutting down of trees<\/p>\n<p>to draw a electric line through the property of the<\/p>\n<p>applicant therein.    The learned District Judge<\/p>\n<p>following, the guide lines given in &#8216;Kumbamma v<\/p>\n<p>K.S.E.B'(2001) KLT 542 reevaluated the compensation<\/p>\n<p>payable to the applicant with reference to the<\/p>\n<p>materials tendered including a commission report<\/p>\n<p>collected in the enquiry.  The claimant was awarded<\/p>\n<p>enhanced  compensation  of   Rs.26,100\/-  with   6%<\/p>\n<p>interest from the date of filing of the petition.<\/p>\n<p><span class=\"hidden_text\">C.R.P Nos.693\/08 AND 326\/08   2<\/span><\/p>\n<p>Impeaching     the    correctness  of   that  order  the<\/p>\n<p>respondent has filed C.R.P 326\/2008 contending that<\/p>\n<p>the compensation awarded by the court is excessive<\/p>\n<p>and unreasonable.        The other revision is filed by<\/p>\n<p>the claimant contending that the parameters taken<\/p>\n<p>by the court to assess the compensation is not<\/p>\n<p>correct and relevant materials produced including<\/p>\n<p>the commission report were not properly appreciated<\/p>\n<p>and the enhanced compensation fixed is very much on<\/p>\n<p>the    lower     side    and   reconsideration  of   the<\/p>\n<p>compensation      due    for   the  damages  caused   is<\/p>\n<p>essential.\n<\/p>\n<\/p>\n<p>          2.       Both    these  revisions  were  heard<\/p>\n<p>together.     At the time of hearing it is submitted<\/p>\n<p>by the counsel on both sides that the decision<\/p>\n<p>rendered    by   the    full  bench  of  this  court  in<\/p>\n<p>&#8216;Kumbamma     v   K.S.E.B'(2001)    KLT  542  has   been<\/p>\n<p>considered by Apex court in &#8216;K.S.E.B v Livisha and<\/p>\n<p>others&#8217; (2007(3)) KLT and it has been held that the<\/p>\n<p>parameters given under that decision cannot be<\/p>\n<p><span class=\"hidden_text\">C.R.P Nos.693\/08 AND 326\/08  3<\/span><\/p>\n<p>applied in all cases.       The apex court in the above<\/p>\n<p>judgment in paragraphs (10) and (11) has laid down<\/p>\n<p>the matters to be          looked into by the court in<\/p>\n<p>adjudging a claim for enhanced compensation on the<\/p>\n<p>ground of damages caused by cutting down trees and<\/p>\n<p>loss of diminution in the value of land by drawing<\/p>\n<p>of overhead lines through the property.         In the<\/p>\n<p>light of the apex court decision, as referred to<\/p>\n<p>above, it is imperative and essential that a fresh<\/p>\n<p>look   into    the   matter  after  setting  aside the<\/p>\n<p>impugned order which is based on           &#8216;Kumbamma v<\/p>\n<p>K.S.E.B&#8217; (2001)KLT 542 is essential.           In such<\/p>\n<p>circumstances both revisions are allowed and the<\/p>\n<p>case is remitted for fresh consideration setting<\/p>\n<p>aside the award passed by the Additional District<\/p>\n<p>Judge.
