Justice K.SURENDRA MOHAN\n\n Dated :25\/01\/2010\n\n O R D E R\n                  K.SURENDRA MOHAN, J.\n                      -------------------------\n                   W.P (C) No.2277 of 2010\n                      --------------------------\n             Dated this the 25th January, 2010\n\n                        J U D G M E N T\n<\/pre>\n<p>     Petitioner who is a stage carriage operator was<\/p>\n<p>issued with a regular permit to operate on the route<\/p>\n<p>Kundara-Mukada-Chirakkara Temple which is          valid till<\/p>\n<p>25.12.2010. The permit was endorsed in respect of Stage<\/p>\n<p>Carriage No.KL-03\/H 5535. According to the petitioner,<\/p>\n<p>the said vehicle is a 2002 model vehicle having 28 seats.<\/p>\n<p>Since the said vehicle was not fit enough to operate on<\/p>\n<p>the route due to mechanical complaints, the petitioner<\/p>\n<p>purchased   another    vehicle,       No.KL-6\/C   9995  and<\/p>\n<p>submitted an application for replacement.        The vehicle<\/p>\n<p>that was sought to be replaced is a 2005 model vehicle<\/p>\n<p>with 38 seats. Since the vehicle was having a higher<\/p>\n<p>seating capacity, the petitioner      contends that it would<\/p>\n<p>have yielded more revenue to the Government. However,<\/p>\n<p>the request of the petitioner for replacement has been<\/p>\n<p>rejected by Ext.P2 order of the 1st respondent.<\/p>\n<p>W.P (C) No.2277 of 2010<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>      2.   According to the learned counsel for the<\/p>\n<p>petitioner, the 1st respondent, Regional Transport Authority<\/p>\n<p>has rejected the application for replacement of the<\/p>\n<p>petitioner&#8217;s vehicle in exercise of the power under Rule<\/p>\n<p>133 (1) of the Kerala Motor Vehicles Rules. It is contended<\/p>\n<p>that the Secretary has the power only to allow replacement<\/p>\n<p>of a vehicle and has no power to reject the application.<\/p>\n<p>According to the learned counsel, the matter should have<\/p>\n<p>been placed before the 2nd respondent, the Regional<\/p>\n<p>Transport Authority. This is because of Rule 174 (3) of the<\/p>\n<p>Kerala Motor Vehicle Rules 1989, which stipulates that,<\/p>\n<p>where the vehicle that is sought to be replaced is materially<\/p>\n<p>different from the earlier vehicle, the application should be<\/p>\n<p>treated as if it were an application for a fresh permit.<\/p>\n<p>      3.   The difference in seating capacity exceeding<\/p>\n<p>25% of that of the earlier vehicle is considered to be a<\/p>\n<p>material difference for the purpose of Rule 174 (3).<\/p>\n<p>      4.   The learned counsel also relies on the decision<\/p>\n<p>of this Court in Viswambharan Vs. State of Kerala [2008 (4)<\/p>\n<p>KLT 674].      In the said      decision, this Court while<\/p>\n<p>W.P (C) No.2277 of 2010<br \/>\n<span class=\"hidden_text\">                              3<\/span><\/p>\n<p>considering     an identical situation has held that the<\/p>\n<p>Secretary, Regional Transport Authority as a delegatee is<\/p>\n<p>not empowered to reject an application under Section 83 of<\/p>\n<p>the Act seeking replacement of one vehicle by another<\/p>\n<p>vehicle. It has been held at page 676 of the said decision as<\/p>\n<p>follows:\n<\/p>\n<blockquote><p>           &#8221; In other words, the Secretary, R.T.A as<br \/>\n     the delegatee is not empowered to reject an<br \/>\n     application under Sec.83 of the Act seeking<br \/>\n     replacement of one vehicle by another.      He can<br \/>\n     consider the application. He can allow the same.<br \/>\n     It is open to him to place an application before<br \/>\n     the RTA which of course is competent to deal<br \/>\n     with it in terms of S.83 of the Act. But, he cannot<br \/>\n     reject the same.&#8221;<\/p><\/blockquote>\n<p>      5.   The above legal position is not seriously disputed<\/p>\n<p>by the learned Government pleader.        In view of the fact<\/p>\n<p>that the 1st respondent had no authority to reject the<\/p>\n<p>petitioner&#8217;s application, it is found that Ext.P2 is<\/p>\n<p>unsustainable. Accordingly, the same is set aside.     There<\/p>\n<p>shall be a direction to the 1st respondent to place the<\/p>\n<p>petitioner&#8217;s application for replacement of the vehicle<\/p>\n<p>before     the 2nd respondent for being considered in<\/p>\n<p>accordance with Section 83 of the Act. The matter shall be<\/p>\n<p>W.P (C) No.2277 of 2010<br \/>\n<span class=\"hidden_text\">                              4<\/span><\/p>\n<p>considered and appropriate orders shall be passed, in<\/p>\n<p>accordance with law, as early as possible at, at any rate,<\/p>\n<p>within a period of one month from the date of receipt of a<\/p>\n<p>copy of this judgment.\n<\/p>\n<p>     The Writ petition is disposed of as above.
