The alleged offences are under Sections 341, 324, 326<\/p>\n<p>and 307 read with Section 34 of the Indian Penal Code and<\/p>\n<p>Section 27 of the Arms Act. According to prosecution, petitioner<\/p>\n<p>(A3) along with other accused wrongfully            restrained and<\/p>\n<p>assaulted de facto complainant and attempted to commit murder.<\/p>\n<p>Iron rod and sword were used for the commission of the offence.<\/p>\n<p>The incident happened on 09.04.2010 at about 10. P.M.<\/p>\n<p>     3. Learned counsel for petitioner submitted that      there is<\/p>\n<p>some discrepancy regarding involvement of the petitioner in the<\/p>\n<p>case. F.I. Statement would show that one &#8220;Jagir&#8221; had inflicted<\/p>\n<p>cut injury on the de facto complainant but Annexure-C would<\/p>\n<p>show that one &#8220;Mubarak&#8221; inflicted the injury. Petitioner&#8217;s name is<\/p>\n<p>not shown in the F.I. Statement. Petitioner actually surrendered<\/p>\n<p>before the police on 12.05.2010 on knowing that he is implicated<\/p>\n<p>in the offences and he is in custody for the past 16 days. It is<\/p>\n<p>also submitted that petitioner is implicated only because he<\/p>\n<p><span class=\"hidden_text\">B.A. No.3112 of 2010             2<\/span><\/p>\n<p>knows the first accused and when the police came to him in<\/p>\n<p>search of the first accused, his whereabouts could not be stated<\/p>\n<p>by petitioner. First accused is yet to be arrested.<\/p>\n<p>      4. Learned Public Prosecutor submitted that as per the<\/p>\n<p>allegations     made,     petitioner had   beaten   the   de  facto<\/p>\n<p>complainant with an iron rod. Though his name is not mentioned<\/p>\n<p>in the F.I. Statement, on investigation, his involvement is<\/p>\n<p>revealed.       Learned Public Prosecutor submitted that he has no<\/p>\n<p>objection in granting bail, but stringent conditions may be<\/p>\n<p>imposed.\n<\/p>\n<p>      5. On hearing both sides, I am satisfied that bail can be<\/p>\n<p>granted on stringent conditions. Hence the following order is<\/p>\n<p>passed:\n<\/p>\n<blockquote><p>                Petitioner shall be released on bail on his<\/p>\n<p>         executing a bond for Rs.50,000\/- with two solvent<\/p>\n<p>         sureties each for the like sum to the satisfaction of<\/p>\n<p>         the Magistrate Court concerned on the following<\/p>\n<p>         conditions:<\/p>\n<blockquote><p><span class=\"hidden_text\">B.A. No.3112 of 2010              3<\/span><\/p>\n<\/blockquote>\n<blockquote><p>               i)   Petitioner   shall   appear    before    the<br \/>\n                    Investigating Officer on every Monday and<br \/>\n                    Thursday, between 10 A.M. and 1 P.M.,<br \/>\n                    until further orders.\n<\/p><\/blockquote>\n<blockquote><p>               ii)  Petitioner shall not enter the limits of the<br \/>\n                    police station within which the incident<br \/>\n                    happened,      except for compliance of<br \/>\n                    condition no.1, until further orders.\n<\/p><\/blockquote>\n<blockquote><p>               iii) Petitioner shall not influence or intimidate<br \/>\n                    any    witnesses   or   tamper    with   the<br \/>\n                    evidence.\n<\/p><\/blockquote>\n<\/blockquote>\n<p>        This petition is allowed.<\/p>\n<p>                                         K.
