Challenge in this writ petition is against Exts.P1 &amp;<\/p>\n<p>P2 orders of assessments completed under Section 17 D of<\/p>\n<p>the Kerala General Sales Tax Act, 1963 (KGST Act).\n<\/p>\n<p>Eventhough the petitioner had filed appeal before the<\/p>\n<p>Tribunal, the same is not registered for want of payment of<\/p>\n<p>the tax amount in dispute, which is mandatory under<\/p>\n<p>Section 17 D (5) of the Act. Petitioner pointed out various<\/p>\n<p>procedural irregularities and violations of the mandatory<\/p>\n<p>provisions of Section 17 D with respect to finalisation of the<\/p>\n<p>assessment.\n<\/p>\n<p>    2.    Validity of Section 17 D was under challenge in a<\/p>\n<p>batch of writ petitions before a Division Bench of this court.\n<\/p>\n<p>While upholding validity of Section 17 D the Division Bench<\/p>\n<p>W.P.(C)No. 34896 of 2009<br \/>\n<span class=\"hidden_text\">                               -2-<\/span><\/p>\n<p>observed as follows;\n<\/p>\n<blockquote><p>    &#8220;Even though we have upheld the validity of the<br \/>\n    statutory provisions, we are unable to uphold the<br \/>\n    impugned assessments for the simple reason that the<br \/>\n    none of the assessments challenged in the Writ<br \/>\n    appeals or in the Writ petitions was completed in<br \/>\n    accordance with the procedure contemplated under<br \/>\n    section 17D. It is clear from clause (g) of Section 17<br \/>\n    D(2) that the team constituted under section 17 (D)<br \/>\n    should fix the venue and date of hearing and hold<br \/>\n    sitting to hear the parties after issuing notice in<br \/>\n    advance to dealers concerned. Further, information<br \/>\n    in this regard should be published in local media as<br \/>\n    well. It is provided in Sub section (3)o f Section 17 D<br \/>\n    that all assessments under Fast Track Method should<br \/>\n    be unanimous decision signed by all team members.<\/p><\/blockquote>\n<p>    It is very clear from the scheme that all the team<br \/>\n    members should sit together, consider the returns<br \/>\n    filed, accounts and records produced, hear the<br \/>\n    parties or their representatives and suggest proposal<br \/>\n    for assessment. If an assessment by consent can be<br \/>\n    passed, then assessment order should be passed in<br \/>\n    accordance with the terms agreed in first sitting<br \/>\n    itself. The assessments that could be completed in<br \/>\n    the first sitting are cases where team of Assessing<br \/>\n    Officers accept the returns filed or with such<br \/>\n    additions which the party agrees. On the other hand,<br \/>\n    if assessment is proposed in deviation with turnover<br \/>\n    returned or against additions over and above if any<br \/>\n    agreed by the parties, then it is for the very same<br \/>\n    team to issue pre-assessment notice containing<br \/>\n    proposal for assessment and the same should be<br \/>\n    signed by all of them. The party should be given<br \/>\n    sufficient time to file objections and the next date of<br \/>\n    public hearing by the committee should be informed<br \/>\n    to the party. Assessment has to be complete after<\/p>\n<p>W.P.(C)No. 34896 of 2009<br \/>\n<span class=\"hidden_text\">                                -3-<\/span><\/p>\n<p>    hearing the party by team on the objection filed to<br \/>\n    the pre-assessment notice and in order to have a<br \/>\n    binding assessment, the assessment should be one<br \/>\n    completed with unanimous agreement of all the team<br \/>\n    members,         In  fact,  ex-parte   assessment   is<br \/>\n    contemplated only when parties who are served<br \/>\n    notice informing the venue and date of hearing fail to<br \/>\n    appear. Here again, we are of the view that there is<br \/>\n    no harm in giving one more opportunity, if the team<br \/>\n    of officers feel that the party is not absenting<br \/>\n    deliberately. Since in all these cases assessments are<br \/>\n    completed by issuing pre-assessment notice by<br \/>\n    individual officers, we feel that the procedure<br \/>\n    contemplated and stated by us above is not strictly<br \/>\n    followed and so much so, orders passed cannot be<br \/>\n    sustained under the provision of Section 17 D. We,<br \/>\n    therefore allow the writ appeals and writ petitions in<br \/>\n    part by vacating the impugned assessment orders,<br \/>\n    but with direction to the assessment team to<br \/>\n    complete the assessment afresh under section 17 D<br \/>\n    within a period of three months from the date of<br \/>\n    receipt of copy of this judgment after issuing notice<br \/>\n    to all parties and after hearing their objections. We<br \/>\n    make it clear that each and every objection raised by<br \/>\n    the parties in the reply to pre-assessment notice<br \/>\n    should be considered and unanimous decision should<br \/>\n    be taken by the team members. We do not want to<br \/>\n    examine the other issues raised in some of the cases<br \/>\n    like challenge against other statutory provisions,<br \/>\n    challenge against penalty orders etc. These issues<br \/>\n    are left open. We leave freedom to the parties to<br \/>\n    challenge the penalty orders before statutory<br \/>\n    authorities because those are not issued under<br \/>\n    section 17 D. So far as challenge against other<br \/>\n    statutory provision are concerned, we leave it open to<br \/>\n    the parties to raise any such challenge, if required,<br \/>\n    after completion of assessments afresh as stated<\/p>\n<p>W.P.(C)No. 34896 of 2009<br \/>\n<span class=\"hidden_text\">                               -4-<\/span><\/p>\n<p>    above&#8221;.\n<\/p>\n<p>      3.    In view of the directions contained in the Division<\/p>\n<p>Bench Judgment cited supra <a href=\"\/doc\/263230\/\">(Hindustan Petroleum Corporation<\/p>\n<p>Ltd. V. Assistant Commissioner and others<\/a>: Writ Appeal<\/p>\n<p>No.1714\/2009 and connected cases Jt:dt:8\/10\/ 2009), I am of<\/p>\n<p>the opinion that the impugned assessments in the writ<\/p>\n<p>petition are not sustainable and hence matters need fresh<\/p>\n<p>disposal by the authority concerned.\n<\/p>\n<p>      4.    Therefore the writ petition is allowed quashing<\/p>\n<p>the impugned assessments finalised under section 17 D and<\/p>\n<p>also the consequential demands raised if any, for realisation<\/p>\n<p>of   amounts        covered under   such   assessments.    The<\/p>\n<p>respondent concerned, (The Fast Track Team) is directed to<\/p>\n<p>take fresh steps necessary for completing the assessments<\/p>\n<p>taking note of the directions contained in the Division<\/p>\n<p>Bench judgment. The fresh assessment as directed above<\/p>\n<p>shall be completed as early as possible, at any rate within a<\/p>\n<p>period of three months from the date of receipt of the copy<\/p>\n<p>of this judgment, after affording adequate opportunities to<\/p>\n<p>W.P.(C)No. 34896 of 2009<br \/>\n<span class=\"hidden_text\">                            -5-<\/span><\/p>\n<p>the petitioner as directed in the Division Bench Judgment<\/p>\n<p>cited above.\n<\/p>\n<p>                                        C.K.
