JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 06\/12\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>\tThis<br \/>\npetition, under Article 226 of the Constitution of India, has been<br \/>\nfiled with the following prayers:\n<\/p>\n<p>(A)\tAdmit<br \/>\nthis Special Civil Application.\n<\/p>\n<p>(B)\tAllow<br \/>\nthis Special Civil Application by issuing writ of mandamus or any<br \/>\nother appropriate writ or direction by directing the Respondent bank<br \/>\nto continue the petitioner in service as Full-time Sepoy with all<br \/>\nconsequential benefits.\n<\/p>\n<p>(C)\tPending<br \/>\nadmission, hearing and final disposal of the present petition be<br \/>\npleased to direct the Respondent authorities to permit the petitioner<br \/>\nto resume his duties subject to outcome of the present petition.\n<\/p>\n<p>(D)\tGrant<br \/>\nsuch other and further relief\/s as being just and proper in the<br \/>\ninterest of justice.&#8221;\n<\/p>\n<p>\tThe<br \/>\npetitioner was working as a part-time Sepoy with the respondent-Bank.<br \/>\nHe was implicated in a criminal case regarding a dispute with his<br \/>\nrelatives. He was arrested and thereafter released on bail, resulting<br \/>\nin his absence with effect from 11.10.1997 to 11.12.1997. The<br \/>\npetitioner was convicted in the said criminal case. However, the<br \/>\norder of conviction was set aside in appeal and the petitioner was<br \/>\nacquitted. The petitioner thereafter made representations dated<br \/>\n23.09.1992, 04.12.1992 and 02.11.1993 to the respondent-Bank<br \/>\nrequesting that he may be permitted to resume duty. When the<br \/>\npetitioner did not receive any response to these representations, he<br \/>\nissued a Legal Notice on 28.08.2010, which has not yet been responded<br \/>\nto.\n<\/p>\n<p>\tHeard<br \/>\nMr.D.M.Devnani, learned advocate for the petitioner. It is submitted<br \/>\nby him that the interest of justice would be met, if the petitioner<br \/>\nis permitted to make a fresh representation to respondent<br \/>\nNo.1, regarding resumption of his duties as part-time Sepoy and\/or<br \/>\nfull-time Sepoy, which may be decided expeditiously.\n<\/p>\n<p>\tOn<br \/>\nthe above statement being made by the learned advocate for the<br \/>\npetitioner, the following order is passed:\n<\/p>\n<p>\tThe<br \/>\npetitioner is permitted to make a fresh representation to respondent<br \/>\nNo.1, who may consider and decide the same, in accordance with law,<br \/>\nas expeditiously as possible  and without avoidable delay, preferably<br \/>\nwithin a period of three months from the date of receipt of a copy of<br \/>\nthis order.\n<\/p>\n<p>\tThe<br \/>\npetition is disposed of, in the above terms.\n<\/p>\n<p>\t\t\t\t\t\t(Smt.Abhilasha<br \/>\nKumari, J.)<\/p>\n<p>(sunil)<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Laljibhai vs Bank on 6 December, 2010 Author: Abhilasha Kumari,&amp;Nbsp;
