BASANT, J.\n\n               -------------------------------------------------\n\n                         B.A.NO. 3665 OF  2007\n\n               -------------------------------------------------\n\n                Dated this the 20th  day of June, 2007\n\n\n\n                                    ORDER\n<\/pre>\n<p>       The   petitioner   faces   indictment   in   a   prosecution   under<\/p>\n<p>Sec.420 of the IPC.   Cognizance has been taken on the basis of<\/p>\n<p>a   final   report   submitted   by   the   police   which,   in   turn,   is<\/p>\n<p>submitted on the basis of a private complaint filed which  was<\/p>\n<p>referred   to   the   police   under   Sec.156(3)   of   the   Cr.P.C.<\/p>\n<p>According to the  petitioner,  he  had no knowledge  whatsoever<\/p>\n<p>of   the   pendency   of   the   proceedings.     No   summons   has   ever<\/p>\n<p>been served on him.   A warrant of  arrest is issued against him<\/p>\n<p>unjustifiably.     He   is,   at   present,   employed   abroad.       The<\/p>\n<p>petitioner   is   excepted   to   be   in   India   during   the   first   week   of<\/p>\n<p>July,   2007.       He   apprehends   that   he   may   be   arrested   in<\/p>\n<p>execution   of   the   warrant.       He   further   apprehends   that   if   he<\/p>\n<p>surrenders   before   the   learned   Magistrate,   his   application   for<\/p>\n<p>bail may not be considered on merits,   in accordance with law<\/p>\n<p><span class=\"hidden_text\">B.A.NO. 3665 OF  2007                    -: 2 :-<\/span><\/p>\n<p>and expeditiously.  He therefore prays that directions under Sec.<\/p>\n<p>438\/482 of the Cr.P.C.   may be issued in his favour.<\/p>\n<p>       2.     It   is   by   now   trite   that   the   directions   under   Sec.438   of<\/p>\n<p>the   Cr.P.C.   can   be   issued   even   in   favour   of   a   person   who<\/p>\n<p>apprehends arrest in execution of  coercive process issued by the<\/p>\n<p>court.       (See  Bharat   Chaudhary   and   another   v.   State   of<\/p>\n<p>Bihar   &#8211;  AIR   2003   SC   4662).     But   even   then,   there   must   be<\/p>\n<p>compelling   reasons   to   invoke   the   powers   under   Sec.438   of   the<\/p>\n<p>Cr.P.C.       This,   I   am     satisfied,   is   not   a   fit   case   where   such<\/p>\n<p>invocation of the powers  is necessary.   It is for the petitioner to<\/p>\n<p>appear before the learned Magistrate and explain to the learned<\/p>\n<p>Magistrate   the   circumstances  under  which   he   could   not  earlier<\/p>\n<p>appear   before   the   learned   Magistrate.     I   have   no   reason   to<\/p>\n<p>assume   that   the   learned   Magistrate   would   not   consider   the<\/p>\n<p>petitioner&#8217;s application for regular  bail on merits in accordance<\/p>\n<p>with   law   and     expeditiously.       No   special   or   specific   directions<\/p>\n<p>appear   to   be   necessary.     Every   court   must   do   the   same.<\/p>\n<p>Sufficient   general   directions   on   this   aspect   have   already   been<\/p>\n<p>issued   in   the   decision   reported   in  <a href=\"\/doc\/147290035\/\">Alice   George   v.   Deputy<\/p>\n<p>Superintendent of Police<\/a>  (2003 (1) KLT 339).<\/p>\n<p>       3.       In   the   result,   this   Crl.M.C.   is   dismissed;   but   with   the<\/p>\n<p><span class=\"hidden_text\">B.A.NO. 3665 OF  2007                 -: 3 :-<\/span><\/p>\n<p>observation  that if  the petitioner surrenders before  the  learned<\/p>\n<p>Magistrate   and   seeks  bail   after   giving   sufficient   prior   notice   to<\/p>\n<p>the   Prosecutor   in   charge   of   the   case,   the   learned   Magistrate<\/p>\n<p>must   proceed   to   pass   appropriate   orders   on   merits   and<\/p>\n<p>expeditiously &#8211; on the date of surrender itself, unless compelling<\/p>\n<p>and exceptional reasons are there.\n<\/p>\n<\/p>\n<p>                                                                  Sd\/-\n<\/p>\n<p>                                                     (R.
