Neither learned counsel for the<br \/>\nrespondent, nor respondent No.2 did not remain present before this<br \/>\nCourt even on second call. I have heard learned Counsel appearing for<br \/>\nthe petitioner. It is contended that petitioner is wife of the<br \/>\nrespondent No.2. She has challenged the order dated 09.07.2007 passed<br \/>\nby the learned Additional Sessions Judge and Fast Track Judge,<br \/>\nMehsana, by which the order dated 21.02.2007 passed by the learned<br \/>\nJMFC, Kheralu revising the maintenance has been quashed and set<br \/>\naside.\n<\/p>\n<p>\tFacts<br \/>\nof the case in brief are that the petitioner had filed maintenance<br \/>\napplication before the learned Magistrate. During the pendency<br \/>\nof the proceedings, the parties had arrived at settlement before the<br \/>\nLok Adalat. By the joint pursis and maintenance was fixed at Rs.650\/-<br \/>\nper month by the learned Magistrate by order dated 05.07.2003. Some<br \/>\nfour years thereafter the petitioner approached the learned<br \/>\nMagistrate for revision of maintenance under Section 127 of the Code<br \/>\nof Criminal Procedure. Learned Magistrate, after hearing both the<br \/>\nsides, allowed the revision by order dated 21.02.2007 fixing the<br \/>\nmaintenance for wife at Rs.2,000\/- per month.\n<\/p>\n<p>\tHusband<br \/>\nchallenged the said order before the learned Additional Sessions<br \/>\nJudge, who, by his impugned order dated 09.07.2007 set aside the<br \/>\nrevision in maintenance on the ground that the issues were already<br \/>\nsettled between the parties before the Lok Adalat.\n<\/p>\n<p>\tI have perused<br \/>\nthe Pursis filed before the Lok Adalat on 25.06.2003 wherein the<br \/>\nhusband has stated that he is able to and willing to pay maintenance<br \/>\nat the rate of Rs.650\/- per month to wife to which since wife had<br \/>\nagreed, accordingly learned Magistrate had fixed the said<br \/>\nmaintenance.\n<\/p>\n<p>\tNothing<br \/>\nin the said Pursis or the order of the learned Magistrate suggests<br \/>\nthat the wife had agreed to receive Rs.650\/- per month by way of<br \/>\nmaintenance for all time to come. No such intention can be red into<br \/>\nthe agreement between the parties. Fixation of maintenance at<br \/>\nRs.650\/- must be reviewed from reasonable perspective. If the wife<br \/>\nhad agreed for the maintenance of Rs.650\/- fixed in Lok Adalat for<br \/>\nall the time to tome, the learned Magistrate should have asked the<br \/>\nquestion whether the compromise was free and just. No reasonable<br \/>\nperson would agree to such a permanent fixation in view of rising<br \/>\nprices of commodities and even if husband&#8217;s income increases. Section<br \/>\n125 provides for maintenance. Section 127 of Cr.P.C. permits the<br \/>\nCourt to vary maintenance fixed under Section 125. Under the<br \/>\nagreement the wife had not abducted her right to file application<br \/>\nunder Section 127 of the Code also.  Learned Additional Sessions<br \/>\nJudge gave rigid interpretation to the compromise Pursis and held<br \/>\nthat for all time to come, the wife had no right to file enhancement<br \/>\napplication. This would be quite contrary to the statutory provisions<br \/>\nunder Section 127 of the Cr.P.C. itself. For example, if the wife had<br \/>\nremarried, by the same logic, the husband would be prevented from<br \/>\ncancelling the order of maintenance altogether. Surely, there was no<br \/>\nsuch intention in the compromise between the parties.\n<\/p>\n<p>\tSince fixation<br \/>\nof maintenance at Rs.2,000\/- per month, was other wise, not pointed<br \/>\nout to be unjust, only on that ground that wife had previously<br \/>\nreceived Rs.650\/- by way of settlement cannot be a ground for<br \/>\ninterfering with the order of the learned Magistrate.\n<\/p>\n<p>\tIn<br \/>\nthe result, the petition succeeds.
