Bharti, SC 14\nFor Private Respondents: Mr. Rana Ishwar Chandra, Advocate\n                   -----------\n<\/pre>\n<p><span class=\"hidden_text\">                                      2<\/span><\/p>\n<p>6   08.12.2010                Heard learned counsel for the petitioner, learned<\/p>\n<p>                 counsel for the State and learned counsel for some of the<\/p>\n<p>                 private respondents.\n<\/p>\n<p>                              According to the petitioner, some public land,<\/p>\n<p>                 which was being used for irrigation and movement of water<\/p>\n<p>                 to meet the needs of public, has been encroached upon by<\/p>\n<p>                 ten persons, who have unauthorisedly constructed shops and<\/p>\n<p>                 houses over the said land and hence the State should take<\/p>\n<p>                 action to evict the encroachers so that the villagers and<\/p>\n<p>                 residents may use their public rights of user of the land as<\/p>\n<p>                 Nala or Aahar.\n<\/p>\n<p>                              From the counter affidavit filed on behalf of the<\/p>\n<p>                 State, it appears that a preliminary inquiry has already been<\/p>\n<p>                 held leading to Encroachment Case No. 1\/2010-11 before<\/p>\n<p>                 the Anchaladhikari, Naubatpur (Patna). The notice issued by<\/p>\n<p>                 the Anchaladhikari dated 26.10.2010 against the alleged<\/p>\n<p>                 encroachers has been annexed as Annexure E to the counter<\/p>\n<p>                 affidavit.\n<\/p>\n<p>                              Learned counsel for the private respondents wants<\/p>\n<p>                 time to raise appropriate defence on behalf of the private<\/p>\n<p>                 respondents.\n<\/p>\n<p><span class=\"hidden_text\">                         3<\/span><\/p>\n<p>               However, considering the nature of the proposed<\/p>\n<p>     order, we do not think necessary to grant time to the private<\/p>\n<p>     respondents for filing a counter affidavit.<\/p>\n<p>               Without going into the merit of allegations made<\/p>\n<p>     by the petitioner, now when the appropriate authority has<\/p>\n<p>     initiated cases for removal of encroachment from public<\/p>\n<p>     land, it would be open for the private respondents to raise<\/p>\n<p>     their defence before the appropriate authority, who is<\/p>\n<p>     directed to dispose of the pending proceeding in accordance<\/p>\n<p>     with law without any delay, preferably within four months.<\/p>\n<p>               With the aforesaid direction\/observation, this writ<\/p>\n<p>     petition is disposed of.\n<\/p>\n<\/p>\n<p>                            (Shiva Kirti Singh, J.)<\/p>\n<p>                            (Dr. Ravi Ranjan, J.)<br \/>\nSC\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Sujay Kumar Pandey vs The State Of Bihar &amp;Amp; Ors on 8 December, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA CWJC No.15413 of 2010 SUJAY KUMAR PANDEY son of Sri Ram Ekbal Pandey, resident of village Nisarapura, P.O.
