PUBLIC PROSECUTOR for\nRespondent \n=========================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE H.B.ANTANI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 21\/01\/2010 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>\tThis<br \/>\napplication is preferred under Section 439 of the Code of Criminal<br \/>\nProcedure for regular bail by the applicant who was arrested  in<br \/>\nconnection with FIR registered as CR No.I   88 of 2009 with<br \/>\nRajpipla Police Station, District: Narmada for the offence punishable<br \/>\nunder Sections 395, 341, 342, 365, 402, 412, 465, 468, 471, 511,<br \/>\n216(A), 120(B) and 34 of the  of the Indian Penal Code.\n<\/p>\n<p>\t Mr.M. A.\n<\/p>\n<p>Kharadi, learned advocate for the applicant submitted that the<br \/>\napplicant has not played any vital role in the alleged commission of<br \/>\noffence and false case is registered against him. Learned advocate<br \/>\nfor the applicant submitted that no role is attributed to the<br \/>\napplicant as can be seen from the FIR at Annexure   A to the<br \/>\napplication and, therefore, it is a fit case to enlarge the applicant<br \/>\non bail. Learned advocate for the applicant has placed reliance upon<br \/>\nthe order dated 06.08.2009 passed by this Court [Coram: Rajesh H.<br \/>\nShukla,J.] in Criminal Misc. Application No.8671 of 2009 and another<br \/>\norder dated 17.07.2009 passed by this Court [Coram: Rajesh H.<br \/>\nShukla,J.] and Criminal Misc. Application No.6808 of 2009 and<br \/>\nsubmitted that considering the fact that other accused persons are<br \/>\nreleased on bail by this Court, even on the ground of parity, the<br \/>\napplicant deserves to be enlarged on bail.\n<\/p>\n<p>\tMr.Umesh<br \/>\nTrivedi, learned APP for the respondent &#8211; State, while opposing the<br \/>\napplication, submitted that the applicant  is involved in serious<br \/>\noffence punishable under Sections 395, 341, 342, 365, 402, 412, 465,<br \/>\n468, 471, 511, 216(A), 120(B) and 34 of the  of the Indian Penal<br \/>\nCode. Learned APP  submitted that as the applicant is a main culprit,<br \/>\nthe application deserves to be dismissed.\n<\/p>\n<p>\tHeard Mr.<br \/>\nM. A. Kharadi, learned advocate for the applicant and Mr.Umesh<br \/>\nTrivedi, learned Additional Public Prosecutor for the respondent<br \/>\nState at length and in great detail.  I have  considered the role<br \/>\nattributed to the applicant which is reflected in the FIR at Annexure<br \/>\n  A,  the police papers produced by the learned APP as well as<br \/>\norder dated 06.08.2009 passed by this Court [Coram: Rajesh H.<br \/>\nShukla,J.] in Criminal Misc. Application No.8671 of 2009 and another<br \/>\norder dated 17.07.2009 passed by this Court [Coram: Rajesh H.<br \/>\nShukla,J.]  in Criminal Misc. Application No.6808 of 2009.<br \/>\nConsidering the role attributed to the applicant, the offence alleged<br \/>\nagainst the applicant, the quantum of punishment and police papers<br \/>\netc., I am of the view that the applicant is required to be enlarged<br \/>\non bail. However, stringent terms and conditions are required to be<br \/>\nimposed on the applicant while releasing him on bail.\n<\/p>\n<p>\tIn the<br \/>\nfacts and circumstances of the case, the application is allowed and<br \/>\nthe applicant is ordered to be enlarged on bail in connection with I\n<\/p>\n<p>&#8211; CR No.88 of 2009 registered at Rajpipla Police Station on executing<br \/>\na bond of Rs.20,000\/- [Rupees twenty thousand only] with two sureties<br \/>\nof the like amount to the satisfaction of the Trial Court and subject<br \/>\nto the conditions that he shall:\n<\/p>\n<p>[a]\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p>[b]\tnot act<br \/>\nin a manner injurious to the interest of the prosecution;\n<\/p>\n<p>[c]\tsurrender<br \/>\nhis passport, if any, to the lower Court within a week;\n<\/p>\n<p>[d]\tnot<br \/>\nleave the State of Gujarat without the prior permission of the<br \/>\nSessions court concerned;\n<\/p>\n<p>[e]\tmark<br \/>\nhis presence at the concerned Police Station on every 1st<br \/>\nand 15th day of English calendar month between 9.00 AM and<br \/>\n2.00 PM. till the trial is over;\n<\/p>\n<p>[f]\tfurnish<br \/>\nthe present address of his residence to the I.O. and also to the<br \/>\nCourt at the time of execution of the bond and shall not change his<br \/>\nresidence without prior permission of this Court;\n<\/p>\n<p>[g]\tmaintain<br \/>\nlaw and order.\n<\/p>\n<p>\tIf breach<br \/>\nof any of the above conditions is committed, the Sessions Judge<br \/>\nconcerned will be free to issue warrant or to take appropriate action<br \/>\nin the matter.\n<\/p>\n<p>\tBail bond<br \/>\nto be executed before the lower Court having jurisdiction to try the<br \/>\ncase.\n<\/p>\n<p>\tAt the<br \/>\ntrial, the Trial Court shall not be influenced by the observations of<br \/>\npreliminary nature, qua the evidence at this stage, made by this<br \/>\nCourt while enlarging the applicant on bail.\n<\/p>\n<p>\tRule is<br \/>\nmade absolute to the aforesaid extent.\n<\/p>\n<p>\tDirect<br \/>\nService is permitted.\n<\/p>\n<p>[H.B.\n<\/p>\n<p>ANTANI, J.]<\/p>\n<p>(vijay)<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court ========================================= vs Mr on 21 January, 2010 Author: H.B.Antani,&amp;Nbsp;
