Case No.<\/p>\n<p>                   42\/2011, pending in the court of Chief Judicial<\/p>\n<p>                   Magistrate, Rohtas, Sasaram, is one of the named<\/p>\n<p>                   accused in this with allegation of assaulting one<\/p>\n<p>                   Ram Awadh Ram by spade in a petty dispute arising<\/p>\n<p>                   out of singing song of Holi Festival.<\/p>\n<p>                             Submission is that there is no explanation<\/p>\n<p>                   for   delayed   information    to   the   police   when<\/p>\n<p>                   occurrence said to have taken place on 20.03.2011<\/p>\n<p>                   at about 8.30 A.M. and the injured after being<\/p>\n<p>                   treated at Barhari, brought back to village and next<\/p>\n<p>                   day when he was bringing to other place, police is<\/p>\n<p>                   said to have been informed. Moreover, injury report<\/p>\n<p>                   also does not corroborated to be inflicted by spade.<\/p>\n<p>                   The petitioner has clean antecedent and this case<\/p>\n<p>                   appears squarely covered under the decision of Apex<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>          Court in a case Jorgia Pentiah Vs.
