(C) No.16552 of 2007)\n\n\nTayyab Ali and Anr.                            ...Appellant(s)\n\n                                        Versus\n\nState of Uttar Pradesh and Anr.     ...Respondent(s)\n\n\n\n                                     O R D E R\n<\/pre>\n<p>           Leave granted.\n<\/p>\n<p>           Heard learned counsel for the parties.\n<\/p>\n<p>           The Tehsildar, Ghaziabad, by his order dated 30th March, 1999, cancelled<br \/>\nthe caste certificates issued in favour of the appellants. That order was challenged by<br \/>\nthe appellants by filing writ petition in the High Court mainly on the ground of<br \/>\nviolation of the rules of natural justice by alleging that their caste certificates were<br \/>\ncancelled without issuing notice and affording them opportunity of hearing. They<br \/>\nalso made a specific prayer for quashing order dated 30th March, 1999. Although the<br \/>\nrespondent did not controvert the assertions contained in the writ petition, the High<br \/>\nCourt dismissed the writ petition by observing that the petitioners did not challenge<br \/>\norder dated 30th March, 1999 despite the fact that copy thereof was supplied to them<br \/>\npursuant to the direction given by it. In our view, the High Court committed serious<br \/>\nerror in dismissing the writ petition without going into the question of violation of the<br \/>\nrules of natural justice.\n<\/p>\n<p>                                                                                   &#8230;.2\/-\n<\/p>\n<p><span class=\"hidden_text\">                                           -2-<\/span><\/p>\n<p>           Accordingly, the appeal is allowed, impugned order passed by the High<br \/>\nCourt is set aside and order dated 30th March, 1999 passed by the Tehsildar cancelling<br \/>\nthe caste certificates of the appellants is quashed.\n<\/p>\n<p>           Needless to say that this order shall not preclude the Tehsildar from<br \/>\npassing a fresh order after giving opportunity of hearing to the appellants.\n<\/p>\n<p>                                                                         &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.J.\n<\/p>\n<p>                                                 [B.N.
