The appellant was the defendant before the trial A’<\/p>\n
a suit for ejectrnent. The appellant is runniiig’  V’<\/p>\n
business in the suit property. The:-tenarlcy’,  Vlbeenxlp<\/p>\n
terminated, the suit was filed for ejectmen_t,i.*A–A_V_A’ if<\/p>\n
2. The suit was contested on “s:.eV–‘eral. V.gr–O_1V_1nVds
\nthat the notice of terminatioh..yvas”lbjacljinllplllaw a\ufb01ndthat there
\nwas no relationship of  ftegiaiitji.,’llp_’_These issues<\/p>\n
having been held the:5appielliantpfAthe same was<\/p>\n
affirmed by  ivcou.-rt and hence the present
\nappeal. . f V
\n a3.  learned\u00bb c’oi,1r1_sel for the appellant would submit<\/p>\n
thatthenoticeVofcttermination is invalid, in that, the appellant<\/p>\n
 i..gs.prunni11g”‘a hotel’j_b}:1siness in the suit property, and therefore<\/p>\n
_l_fi~t.ys{ou1d be a \ufb01rlanufacturing purpose” for which the property<\/p>\n
 ‘ be*ir1gputi~1ized and hence in the absence of a contract to the<\/p>\n
.  the tenancy would be deemed to be year to year and<\/p>\n
 months’ notice was necessary in terms of Section 106 of<\/p>\n
the Transfer of Property Act, whereas the notice issued was a<\/p>\n
for 15 days notice and therefore was invalid. Secondly;<\/p>\n
the property belonged to several persons. Notice  ‘<\/p>\n
issued on behalf of one of the owners.’ was.”tl\u00a7ieref0iie,’i’v.,<\/p>\n
incompetent and the suit could not hm  ‘~ . by”<\/p>\n
plaintiff in that capacity. It is furthgerlpcontended the
\nalternative, the Very relatiorishipcilolj ‘laiidlard and” tenant is
\ndenied and that this having    the appellant.<\/p>\n
was on a misreading ofthe eyidensce ‘a:ndj_’the_:pleadings.\n<\/p>\n
4. On the of;herIj_y.hai1d,___ the –._ie:arIied counsel for the<\/p>\n
respondent would  contention as to the notice
\nbeing in valid in  ” 106 of the Transfer of
\nProperty  neVer__raised. The objection was only with<\/p>\n
regard  ..the.__’not.ic’e.__having been issued by one of the co~<\/p>\n
  them. This has been negatived by the<\/p>\n
_\ufb02coui*t$ belfowvh; hvliurther, in so far as the hotel being a<\/p>\n
‘i.rrianufacturing purpose and therefore notice of six months<\/p>\n
it  compulsory in terms of Section 106 of the Transfer of<\/p>\n
 Act, it is pointed out that admittedly the tenancy<\/p>\n
 was month to month and the Section itself would indicate<\/p>\n
that it is in the absence of a contract to the contrary that the<\/p>\n
condition of a six months’ notice would arise. Therefore,_d”it_li~s<\/p>\n
not tenable to hold that the termination notice of  ~<\/p>\n
invalid in law.   e<\/p>\n
5. Further in so far as one c’o.~v.lo*.vnei~_:
\ncompetent to institute the proceedings_l_’thVe  have
\ncategorically addressed the  reliance on
\nthe decisions of this court  Hence there
\nis no ground     there is no
\nsubstantial    consideration. The
\n\ufb01ndings are do not warrant consideration<\/p>\n
as substantial (fuestion  this Court.\n<\/p>\n

an issue as to whether the plaintiff proved that Sl’1(3.4vlfi’i”-.t>ll<_3<\/p>\n
landlord and that the defendant is a tenant underhertq .<\/p>\n

8. l”lowever4,’\u00b0inV the in.terest of justice, the appellant is
\ngranted’ one Vyearfs tinitemtto quit and deliver the vacant<\/p>\n
  property having regard to the fact that<\/p>\n
the appe’ll_ant_v’isVfriinning a business in the premises and<\/p>\n
W”ther.epfbrep to “relocate and establish himself elsewhere, he<\/p>\n
 sufficiently reasonable time. Accordingly, it<\/p>\n
  reasonable to grant one year’s time to quit and<\/p>\n
“‘*inp_\u00b0V,aeate the premises. This concession is in spite of vehement<\/p>\n

objection by the learned counsel for the respondent who<\/p>\n
would submit that when the appeai is being dismissed–.__on<\/p>\n
