Dhavan and V.P. Goel, JJ.<\/p>\n<p>1. This writ petition is, in effect, in the realm of a public interest litigation though the calamity which aggrieves two of the petitioners on the loss of their sons is neither an issue on record nor the cause which caused their death. The only sin of the two young lads was that on a certain day on 11.9.1986, Prabhat Tripathi, a student of 11th standard in Colonelganj Inter College, Allahabad and the eldest son of Vijai Kumar Tripathi, r\/o 4, Minto Road, Allahabad and Daya Shankar Tripathi, a graduate and son of Raj Narain Tripathi, r\/o village Pahlepar, at P.O. Bhingwa, district Pratapgarh, never knew what providence had ordained for them.\n<\/p>\n<p>2. Daya Shankar Tripathi had come to fill a form in civil police for the post of a Sub-Inspector. He was staying with his uncle. During the evening of 11.9.1986 there was a heavy downpour with a nasty storm. After the storm abated, Vijai Kumar Tripathi asked his son Prabhat Tripathi and his nephew Daya Shankar at about 8.00 in the evening to fetch some kitchen provisions for the evening meal. After 45 minutes a boy of the locality barged into the house of Vijai Kumar Tripathi to announce the horror that 100 yards away from the house two persons had been electrocuted and lay dead in front of the residence of a leading doctor. Vijai Kumar Tripathi and his wife rushed to the scene where the two bodies lay dead. Little did they realise that what lay in front of them were the stone dead bodies of their son and nephew. An attempt by the mother to touch the body was foiled by the father as the puddle from the rain and storm was still carrying electric current from the live wire which had snapped and fallen.\n<\/p>\n<p>3. The parents fainted to gain consciousness after a couple of hours. The incident was reported at P.S. Civil Lines, Allahabad and is so recorded in the General Diary No. 53 at 21.50 hours on the evening of the tragedy itself. The current which continued to flow from the live wire, even almost two hours after the tragedy, it is said, was switched off at 10.30 p.m. The next day saw the cremation of these two young lads.\n<\/p>\n<p>4. One month after the tragedy this petition was filed with the allegations that the transmission lines of the U.P. State Electricity Board had not conformed with the safety measures nor have been laid as such that in the event of an incident like the present one in-built safety procedures should trip the transmission lines of electricity. Unfortunately, in the present case, it did not.\n<\/p>\n<p>5. At least, by good grace, the incident is not denied by the U.P. State Electricity Board, the party respondents. The cause of death is accepted because it was a live wire which fell as a sequel to the storm and the current ought to have tripped; it did not. The situation is explained that it was beyond the control of the Board. A suggestion was made that it was an act of God. It is pleaded in the counter affidavit that compensation is available should the parents of the two young lads who had died, approach the Board, but that authority is only to the limit of Rs. 5,000\/- and Rs. 10,000\/- for injury and death, as the case may be. The issue then is not what compensation the parents of these two young lads sought to receive and, in principle, it is accepted that compensation may be a remedy.\n<\/p>\n<p>6. The storm which came on 11.9.1986 may be an act of God, but not the current which continued to flow through the transmission lines. This court is not going into the question of strict proof liability on who exactly may have been responsible and in the generality of it. But whoever ventures in public utility services and in the context of today, whether it is a public enterprise or a private, guaranteeing safety to citizens and rate payers, is an obligation which goes simultaneously with these ventures. The court cannot accept a system that should there be a cyclone or a storm then the logic is inevitable that it must see a minimum amount of deaths arising out of falling transmission lines or of roads which will cave in and the pits will draw into its vortex any body passing over them.\n<\/p>\n<p>7. The court is not reproducing the text of the submissions in the writ petition nor of the counter affidavit as the tragedy is accepted. But a passage necessarily needs to be reproduced for the purposes of record that between the tragedy of two young lives lost and the cause being the collapsing transmission lines, the nexus is not in issue: &#8220;It is stated that the department has got full sympathy for the affected persons on account of the unfortunate incident. It is not correct that there was any delay or lapse on the part of the staff.&#8221; The contention of the Board is that they are extremely sorry for the unfortunate incident on the night of 11.9.1986 which was unforeseen with the transmission lines snapping and electric current continuing to flow.\n<\/p>\n<p>8. This court will not go into the interpretation of the explanation nor would it be appropriate for the court to dissect the contentions in the counter affidavit to explain the situation because the only thing which will come out of it is that others did not venture into the area of the gaping death trap.\n<\/p>\n<p>9. Regard being had to overall circumstances, of the shock and trauma to which the parents were subjected by sending the children to the bazar to shop for their mother waiting to cook the evening meal, but never to see the return of the children, discover that 100 yards away from their house they lay dead by electrocution, persuades the court that no compensation would ever relieve the grief of the bizarre incident on 11.9.1986. But, if the Board did have the power that compensation may visit to parents of these two young lads, then, it should have been done by now and the gesture should not have awaited the result of this writ petition, fated to come up for hearing after 10 years as in causes like these, counsel lose interest in dockets and grief and time put together sustain little interest on those who suffered the tragedy. The court mentions this aspect as today there is an adjournment slip of counsel for the petitioners but the court is not ready to adjourn this matter so that it remains pending for another 10 years.\n<\/p>\n<p>10. Learned counsel for the respondent Board, Mr. Sudhir Agarwal is present but candidly submitted that beyond what is submitted in the counter affidavit he is hardly in a position to submit anything more and, thus, leaves the matter to the equity of the court.\n<\/p>\n<p>11. The court will never be able to adjust equity in a matter like this nor can the court award damages on a strict proof liability rule as that door will always remain open for the parents of these two young lads. But much water has flown with changed times that compensation as a measure of damage in public law has come to stay. Given an appropriate occasion, the court feels that this is an appropriate occasion.\n<\/p>\n<p>12. In the circumstances, the court directs that the U.P. State Electricity Board will, within two months from today, deliver a compensation amount representing Rs. 75,000\/- to each of the parents, i.e., Rs. 75,000\/- to the father of Prabhat Tripathi, namely, Vijai Kumar Tripathi, the petitioner No. 2 and Rs. 75,000\/- to the father of Daya Shankar Tripathi, namely, Raj Narain Tripathi, the petitioner No. 3.\n<\/p>\n<p>13.
