The ticket<br \/>\nNo.371 was found on Top of the Block whereas while checking each<br \/>\nticket of the said block having denomination of Rs.8.25, the tickets<br \/>\nNo.353, 354, 355, 356 were found in between the block.  Thus, the<br \/>\nrespondent had intentionally shown ticket No.31 in his handwriting<br \/>\nand ticket No.341 was not shown in issued column.  Thus, with a bad<br \/>\nintention to collect these tickets back and reissue the same as and<br \/>\nwhen possible, the closing of accounts were not made in the Way-Bill<br \/>\nfor the tickets-block of denomination of Rs.8.25\/- tickets.  The<br \/>\nrespondent had not shown the details of tickets issued in sale column<br \/>\nand also not shown the total in the way-bill.  The Departmental<br \/>\nInquiry was held and competent authority had imposed punishment of<br \/>\nstoppage of annual increments for three years with future effect.\n<\/p>\n<p>2.1\t\tAgainst<br \/>\nthe said order of competent authority, the respondent has preferred a<br \/>\nreference before the Labour Court and the Labour Court has passed the<br \/>\njudgment and award as aforesaid and the said judgment and award of<br \/>\nthe Labour Court has given rise to this petition.\n<\/p>\n<p>3.\t\tLearned<br \/>\nAdvocate for the petitioner has mainly submitted that respondent was<br \/>\nworking as conductor and checking was carried out, certain<br \/>\nirregularities were found and therefore the penalty of stoppage of<br \/>\nannual increments for three years with future effect was imposed.\n<\/p>\n<p>4.\t\tHaving<br \/>\nperused the papers and having heard the learned Advocates for the<br \/>\nparties, it is clear that respondent had committed eight defaults and<br \/>\ntherefore I am of the view that interest of justice would be met by<br \/>\nimposing a penalty of stoppage of one increment with future effect,<br \/>\nwhich was imposed on 16\/12\/1994.\n<\/p>\n<p>5.\t\tIn<br \/>\nthe above premises, the petition is partly allowed by imposing a<br \/>\npenalty of stoppage of one increment with future effect. Rule is made<br \/>\nabsolute to the aforesaid extent. Such penalty shall be imposed from<br \/>\n16\/12\/1994. The consequential benefits will be paid within a period<br \/>\nof six months from the date of receipt of writ of this order.
