    This  appeal     is      preferred        against  the<\/p>\n
judgment and decree passed by the Subordinate<\/p>\n
Judge, Muvattupuzha in O.S.267\/94.             The suit is<\/p>\n
for a declaration and recovery of possession.<\/p>\n
It is the case of the plaintiff that Pazhoor<\/p>\n
Perumthrikkovil Temple is an ancient Temple of<\/p>\n
the State and it is owned by 14 families and<\/p>\n
those  members  of     the     14   families     under  an<\/p>\n
agreement  dated     22.1.66       has      entrusted  the<\/p>\n
administration of the Temple with the first<\/p>\n
defendant for a period of six years or until a<\/p>\n
new body is created for the administration of<\/p>\n
the Temple.  Now it is the case of the plaintiff<\/p>\n
that   nine   such       families         being    totally<\/p>\n
dissatisfied with the management conducted by<\/p>\n

the first defendant had cancelled the power of<\/p>\n
management in favour of D1 by virtue of Ext.A1<\/p>\n
and therefore challenges the alienation made by<\/p>\n
the first defendant in favour of strangers and<\/p>\n
thus a suit for recovery of possession is filed<\/p>\n
on the strength of title.\n<\/p>\n
      2.   On the other hand defendants 1 to 3<\/p>\n
would contend that the management of the temple<\/p>\n
takes in the power to deal the with the property<\/p>\n
and it has not been cancelled by Ext.A1 and<\/p>\n
therefore the plaintiff has no locus standi at<\/p>\n
all to file the suit.     It is stated that though<\/p>\n
the agreement Ext.A1 is alleged to be written in<\/p>\n
the     month   of  September  1994   it  is   seen<\/p>\n
registered only on 14.11.94 and at that time one<\/p>\n
of    the    signatories to   the  document  namely<\/p>\n
Jayananthan Namboodiri was not alive as he died<\/p>\n
on 9.11.94.       It is also stated that though two<\/p>\n

of the persons representing two Illoms’ were<\/p>\n
incompetent to represent the Iloms and therefore<\/p>\n
at the most only there were six illoms that had<\/p>\n
joined Ext.A1 and so the document Ext.A1 would<\/p>\n
not have any binding effect so as to cancel<\/p>\n
Ext.B3 which was entered into by the members of<\/p>\n
the family.      The Court also on an appreciation<\/p>\n
of the materials came to the conclusion that<\/p>\n
Ext.A1 as such does not take away or invalidate<\/p>\n
Ext.B3 and therefore held that the plaintiff was<\/p>\n
not competent to institute a suit.    It was also<\/p>\n
held by the Court that as per Ext.A1 the persons<\/p>\n
who has to institute the suit are the president<\/p>\n
and the treasurer whereas they have not joined<\/p>\n
as such in that capacity and therefore the suit<\/p>\n
is not maintainable on that ground also.   It has<\/p>\n
to be stated that the suit is filed on the<\/p>\n
strength of Ext.A1.       It is not filed in the<\/p>\n

capacity of a member of a family or beneficiary.<\/p>\n
According to the plaintiffs Ext.A1 confirms the<\/p>\n
right of the plaintiff to institute the suit.<\/p>\n
But in the light of the finding rendered by the<\/p>\n
learned Subordinate Judge that the majority of<\/p>\n
the families are not there in Ext.A1 and further<\/p>\n
when the members who had instituted the suit are<\/p>\n
not competent under Ext.A1 also to file the<\/p>\n
suit,       the suit itself is not maintainable.<\/p>\n
When the suit itself is not maintainable, it is<\/p>\n
not proper on the part of the Court to enter<\/p>\n
into a finding regarding the transaction entered<\/p>\n
into between the parties.    I make it very clear<\/p>\n
that I am not expressing anything on merits with<\/p>\n
respect to the transaction and it is a matter<\/p>\n
that has to be considered only in a properly<\/p>\n
constituted suit.    Therefore the finding entered<\/p>\n
into by the Subordinate Judge in this case would<\/p>\n

not     militate   against  the  parties  who  are<\/p>\n
competent to file a proper suit.     It is for the<\/p>\n
Court to consider the merits and demerits of<\/p>\n
both the sides and decide the issue in that<\/p>\n
case.       Therefore this appeal is disposed of<\/p>\n
holding     that  the  present  plaintiffs on  the<\/p>\n
strength of Ext.A1 are not entitled to institute<\/p>\n
the    suit    and therefore  the  suit  cannot be<\/p>\n
entertained.      Parties are at liberty to file a<\/p>\n
fresh litigation, in accordance with law, where<\/p>\n
all the matters can be considered by the Court<\/p>\n
when it is a properly framed suit.<\/p>\n
