4. The \ufb01ial Court in the course of deciding the suit
\nframed as many as 13 issues for consideration. Issue No.11<\/p>\n
was with negate to the fact whether the suit has been \ufb01led<\/p>\n

within time. The mm Court on
\nconsidering the evidence, came
\nsuit is time barred. Eiren though  V’
\nother issues, the suit came   on the
\nground of limitation,   ‘judgment and

5. I   learned Counsel
\n Viespondents, some of Whom
\nare  and the Counsel for
\nthe othef”xespo\ufb01de\u00a71ts <\/p>\n
,    E\u00a7.”S;K.a;z1:a.te, the learned Counsel appearing for<\/p>\n
‘  V  contends that the trial Court committed an<\/p>\n
H ‘mixer :sd’e:;91\u00a2;tisg that the suit is barred by limitation. In<\/p>\n
 tie contends that the his} Court could not have<\/p>\n
  A’1el=i.ed on certain stray statemeets made by the plainti\ufb01’ in<\/p>\n
 to some to the conclusion with regard to the<\/p>\n

the plaint, he contends that the ma} Court has misconstrued<\/p>\n

   misrepresentation, fraud and undue<\/p>\n
 He therefore concludes by submitting<\/p>\n

there are no grounds to entertain this appeal for the<\/p>\n
