The alleged offence is under Section 55(i) of Abkari<\/p>\n<p>Act.   According to prosecution, 1.300 litres of Indian made<\/p>\n<p>foreign liquor was seized from the shed attached to a building<\/p>\n<p>which belongs to the petitioner. The said article was stored for<\/p>\n<p>the purpose of sale and petitioner was also engaged in sale.<\/p>\n<p>     3.    Learned counsel for the petitioner submitted that no<\/p>\n<p>offence will be made out against the petitioner. There is<\/p>\n<p>absolutely no records or materials to establish that the place<\/p>\n<p>from where the article seized, belongs to the petitioner. In the<\/p>\n<p>absence of this, he cannot be made liable for possession of<\/p>\n<p>liquor. Even if the entire allegations are accepted, petitioner was<\/p>\n<p>in possession of only permissible quantity of Indian made foreign<\/p>\n<p>liquor, but, such possession will not constitute any offence. To<\/p>\n<p>establish that the article was stored for sale and that sale was<\/p>\n<p>being conducted, there must be evidence. But, no evidence is<\/p>\n<p><span class=\"hidden_text\">BA No.6121\/08                    2<\/span><\/p>\n<p>available to show that petitioner was engaged in sale, except a<\/p>\n<p>vague statement. Hence, petitioner is entitled for anticipatory<\/p>\n<p>bail, it is submitted.\n<\/p>\n<p>      4.     Learned public prosecutor opposed this application<\/p>\n<p>and submitted that witnesses were questioned and from their<\/p>\n<p>statements, it is revealed that the place from where the article<\/p>\n<p>was seized belongs to the petitioner. There is no Panchayath<\/p>\n<p>number for the building or the shed from where the article was<\/p>\n<p>seized and therefore, no document will be available to prove<\/p>\n<p>this case. The investigation is being conducted into for getting<\/p>\n<p>documents relating to possession of property by the petitioner.<\/p>\n<p>It is also submitted that witnesses have stated that the petitioner<\/p>\n<p>used to sell Indian made foreign liquor from the property.<\/p>\n<p>Therefore, the article is stored for sale, which is an offence<\/p>\n<p>under Section 55(i) of Abkari Act, it is submitted.<\/p>\n<p>      5.     On hearing both sides, it is clear that there is only an<\/p>\n<p>allegation that petitioner was engaged in sale of liquor, but,<\/p>\n<p>admittedly, he was not present at the scene. The details of the<\/p>\n<p>person to whom liquor used to be sold, the date on which the<\/p>\n<p>article was sold and in what manner he was engaged in sale etc.<\/p>\n<p><span class=\"hidden_text\">BA No.6121\/08                     3<\/span><\/p>\n<p>are not specifically stated, but, there is only a general statement<\/p>\n<p>that he used to sell liquor. The mere possession of Indian made<\/p>\n<p>foreign liquor is not an offence unless it is above the permissible<\/p>\n<p>quantity of 3.00 litres. But, the quantity involved is 1.300 litres.<\/p>\n<p>      In the above circumstances, I find that petitioner has an<\/p>\n<p>arguable case and if, anticipatory bail is refused to the<\/p>\n<p>petitioner, he will be put to irreparable injury, since he is likely<\/p>\n<p>to be remanded.\n<\/p>\n<p>      Hence, the following order is passed:\n<\/p>\n<blockquote><p>           Petitioner shall be released on bail in the event of his<\/p>\n<p>           arrest on his executing bond for Rs.25,000\/- with two<\/p>\n<p>           solvent sureties each for the like sum to the<\/p>\n<p>           satisfaction of the arresting officer on condition that<\/p>\n<p>           petitioner will not commit any offence.<\/p>\n<\/blockquote>\n<p>      The petition is allowed.\n<\/p>\n<\/p>\n<p>                                                 K.HEMA, JUDGE<br \/>\ncsl<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Manikyam vs State Of Kerala on 22 October, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 6121 of 2008() 1.
