Appellant was granted interim compensation of Rs.\n<\/p>\n<p>    12,000\/-    under     Section       140       of    the     Motor        Vehicles         Act.\n<\/p>\n<p>    Appellant is held not entitled to additional compensation on<\/p>\n<p>    determination of his claim under Section 166 of the Act.\n<\/p>\n<p>    This is how he is aggrieved against the                          judgment and award<\/p>\n<p>    passed on 5.12.1995 by the Member, Motor Accident Claims<\/p>\n<p>    Tribunal, Buldana         in Claim Petition No. 5 of 1992.\n<\/p>\n<p>    2.          Learned    igcounsel     for      the    appellant           contends         that<\/p>\n<p>    there was sufficient space for the bus to pass through which<\/p>\n<p>    fact is sufficient to establish that the driver was rash and<\/p>\n<p>    negligent in driving the vehicle.                    He contends that removal<\/p>\n<p>    of   testicle,    even     according          to   the     Tribunal,          amounts         to<\/p>\n<p>    privation    of    lump     which    is       a    permanent         disability           and,<\/p>\n<p>    therefore, rejection of claim is bad in law. Due to the<\/p>\n<p>    accident, appellant has lost his ability to conceive a woman.\n<\/p>\n<p>    Learned    counsel    for    respondents            has,     on     the     other       hand,<\/p>\n<p>    supported the award.\n<\/p>\n<p>    3.          Dr    Vijay    Chopde     (witness           no.2)      examined         by     the<\/p>\n<p>    appellant has admitted that with one testicle the injured can<\/p>\n<p>    have reproductive capacity and he is able to give birth to a<\/p>\n<p>    child.     He has denied the suggestion that a person without<\/p>\n<p><span class=\"hidden_text\">                                                             ::: Downloaded on &#8211; 09\/06\/2013 16:03:08 :::<\/span><br \/>\n<span class=\"hidden_text\">                                               3<\/span><\/p>\n<p>    one testicle cannot conceive a woman. In cross-examination he<\/p>\n<p>    has deposed that removal of one testicle is not an impediment<\/p>\n<p>    to    enjoy   sex   and    physical       capacity     also       of    such       person<\/p>\n<p>    remains unaffected.\n<\/p>\n<p>    4.            On perusal of record I find that the appellant had<\/p>\n<p>    not produced any bills to establish that he had spent Rs.\n<\/p>\n<p>    10,000\/- or so over purchase of medicines. No record as to<\/p>\n<p>    the hospitalization of appellant for five weeks has been<\/p>\n<p>    adduced on record.      ig   Doctor who was examined by appellant,<\/p>\n<p>    did    not    depose     anything    about       injury      to      right       leg      of<\/p>\n<p>    appellant.       It is doctor&#8217;s evidence that appellant&#8217;s over-all<\/p>\n<p>    physical      capacity    has remained unaffected and, therefore,<\/p>\n<p>    claim of the appellant that he is unable to earn as a coolie,<\/p>\n<p>    is without any substance.                Loss of his sexual capacity is<\/p>\n<p>    also not established.           On the contrary, doctor has deposed<\/p>\n<p>    that the appellant can conceive a woman and can have normal<\/p>\n<p>    sex.\n<\/p>\n<p>    5.            The appellant was granted              interim compensation of<\/p>\n<p>    Rs.    12000\/-    under    Section       140   of    the   Act.          The     finding<\/p>\n<p>    rendered by the Tribunal that the claimant is entitled to<\/p>\n<p>    additional       compensation       of     Rs.      7000\/-      on      all      counts,<\/p>\n<p>    therefore, needs no interference.\n<\/p>\n<p><span class=\"hidden_text\">                                                         ::: Downloaded on &#8211; 09\/06\/2013 16:03:08 :::<\/span><br \/>\n<span class=\"hidden_text\">                                      4<\/span><\/p>\n<p>    6.
