Mukherjee, Sr Advocate<br \/>\n                                       With Shanti Pratap, Advocate<br \/>\n                For the State       : Mr Sushil Kumar Jha, AC to GP 18\n<\/p>\n<p>                                           &#8212;&#8212;&#8211;\n<\/p>\n<p>5   27.6.2011            Heard learned counsel for the appellants and learned<\/p>\n<p>                counsel for the State.\n<\/p>\n<p>                         The relief which the writ petitioners sought from this<\/p>\n<p>                Court was to command the respondents to consider the case of<\/p>\n<p>                the petitioners for appointment against sanctioned and vacant<\/p>\n<p>                class IV posts under the Darbhanga Collectorate and its<\/p>\n<p>                offices. Further relief sought for was for declaring that non-<\/p>\n<p>                consideration of their case for such appointments is illegal and<\/p>\n<p>                arbitrary.\n<\/p>\n<p>                         Although learned counsel for the appellants has<br \/>\n<span class=\"hidden_text\">                     -3-<\/span><\/p>\n<p>     referred to Annexure- 2, an order passed in the year 1996 in a<\/p>\n<p>     writ petition of the year 1994 preferred by Bihar Rajya Fourth<\/p>\n<p>     Grade Employees Association District Unit and others, we do<\/p>\n<p>     not find that the appellants can be granted any other<\/p>\n<p>     observation for their benefit except what has been indicated in<\/p>\n<p>     the order under appeal. No appointment made earlier or any<\/p>\n<p>     order has been challenged by the appellants and they are<\/p>\n<p>     claiming relief of consideration only on the basis of a panel of<\/p>\n<p>     the year 1992. Sufficient observations in their favour have<\/p>\n<p>     already been made by the Writ Court. It is not possible to<\/p>\n<p>     grant any other relief to the appellants. In our view, there is<\/p>\n<p>     no finding given by the Writ Court on any issue of fact so as<\/p>\n<p>     to prejudice the case of the appellants. We are also of the view<\/p>\n<p>     that authorities shall consider the case of the appellants also<\/p>\n<p>     while considering case of others eligible candidates in<\/p>\n<p>     accordance with law.\n<\/p>\n<p>              The appeal is disposed of accordingly.<\/p>\n<p>                                         (Shiva Kirti Singh, J.)<\/p>\n<p>                                             (V.
