Dubey, learned counsel for the petitioner and Sri Pankaj<br \/>\nSaxena, learned Standing Counsel appearing for the respondents.<br \/>\nThe learned counsel for the parties are agreed that the controversy involved in<br \/>\nthe present Writ Petition is covered by the earlier decisions of this Court,<br \/>\nreferred to hereinafter in the present Judgment, and therefore, the present Writ<br \/>\nPetition may be decided at this stage itself.\n<\/p>\n<p>As per the averments made in the Writ Petition, the petitioner is working on<br \/>\nthe post of Reader and Head of the Department in English in Maharaja Harish<br \/>\nChandra P.G. College, Moradabad. The date of birth of the petitioner is<br \/>\n1.5.1953, and she is to attain the age of superannuation on 30.4.2015, and is<br \/>\ndue to retire on 30.6.2015 after getting Session benefit.\n<\/p>\n<p>It is, interalia, stated in the Writ Petition that the aforesaid College is affiliated<br \/>\nto Mahatma Jyotiba Phule Rohil Khand University, Bareilly.\n<\/p>\n<p>It appears that initially the petitioner opted for Contributory Provident Fund<br \/>\nScheme (CPF). However, in the year 2004, the petitioner exercised her option<br \/>\nin terms of the Government Order dated 25.8.1999 for switching over from<br \/>\nContributory Provident Fund Scheme (CPF) to General Provident Fund<br \/>\nScheme (GPF) with Pension. The intimation in regard to the exercise of<br \/>\noption in the year 2004 by the petitioner was sent by the Principal of the<br \/>\nCollege to the Director of Higher Education, U.P., Allahabad by the<br \/>\nCommunication dated 2.5.2004 (Annexure-7 to the Writ Petition).\n<\/p>\n<p>It is, interalia, prayed in the Writ Petition that writ, order or direction in the<br \/>\nnature of mandamus be issued directing the respondents to accord the benefit<br \/>\nof GPF plus Pension Scheme to the petitioner in accordance with the<br \/>\nGovernment Order dated 25.8.1999, and various decisions of this Court.\n<\/p>\n<p>                         Facts relevant for deciding the present Writ Petition are as under.\n<\/p>\n<p>                        The State Government from time to time has issued Government Orders<br \/>\n                        permitting the teachers to exercise their options for switching over from<br \/>\n                        Contributory Provident Fund Scheme (CPF) to General Provident Fund<br \/>\n                        Scheme (GPF) with Pension.\n<\/p>\n<p>                        The last such Government Order was issued on 25.8.1999 (Annexure 5 to the<br \/>\n                        Writ Petition) which permitted the teachers to exercise their options before<br \/>\n                        one year of their retirement. However, by the Government Order dated<br \/>\n                        5\/6.5.2000 (Annexure 6 to the Writ Petition), a clarification was issued that<br \/>\n                        option could be exercised only by such teachers, who were governed under<br \/>\n                        the General Provident Fund Scheme and not under the Contributory Provident<br \/>\n                        Fund Scheme.\n<\/p>\n<p>                        It appears that this Court in Civil Misc. Writ Petition NO. 25140 of 2001 (Dr.<br \/>\n                        Shri Gopal Gupta and others Vs. State of U.P and others) considered the<br \/>\n                        aforesaid Government Orders dated 25.8.1999 and 5\/6.5.2000, and held by the<\/p>\n<p>                        Judgment and Order dated 26th October, 2006 as follows:\n<\/p>\n<p>&#8220;&#8230;.The policy of the Government providing benefit of GPF plus pension Scheme at no point of<br \/>\ntime denied the benefits to those teachers who had not opted for the said scheme prior to 25th<br \/>\nAugust, 1999 or during the period prescribed either in the Government Order of 1980 or 1982.<br \/>\nSince the scheme remained in existence and time for giving option was extended from time to<br \/>\ntime, the interpretation given by the State to the aforesaid Government order dated 25 th August,<br \/>\n1999 and the clarifications dated 5th June, 2000 and 12th July, 2000 cannot be sustained in the<br \/>\neyes of law.\n<\/p>\n<p>The petitioners who had applied\/opted for GPF plus pension scheme though they were covered<br \/>\nunder the CPF scheme, one year before their date of retirement i.e. during the extended period as<br \/>\nper the Government Order dated 25th August, 1999 could not have been refused the said benefit<br \/>\non the ground that the aforesaid scheme\/option was open only for those teachers who are<br \/>\ncovered by the GPF scheme&#8230;&#8230;..&#8221;\n<\/p>\n<blockquote><p>                        Copy of the said Judgment and Order dated 26th October, 2006 has been filed<br \/>\n                        as Annexure 8 to the Writ Petition.\n<\/p><\/blockquote>\n<blockquote><p>                        It further appears that the State Government filed a Special Leave Petition<br \/>\n                        before the Supreme Court being Petition for Special Leave to Appeal (Civil)<br \/>\n                        No. 722 of 2008.\n<\/p><\/blockquote>\n<p> By the Order dated 3.11.2008 (Annexure 9 to the Writ Petition), their<br \/>\nLordships of the Supreme Court dismissed the said Special Leave Petition.\n<\/p>\n<p>Thus, the aforesaid Judgment and Order dated 26th October, 2006 became<br \/>\nfinal.\n<\/p>\n<p>This position has not been disputed by the learned Standing Counsel.\n<\/p>\n<p>In our opinion, the petitioner in the present Writ Petition, who exercised her<br \/>\noption in the year 2004 in terms of the Government Order dated 25.8.1999, is<br \/>\nentitled to the benefit of GPF Scheme with Pension.\n<\/p>\n<p>As noted earlier, the petitioner is due to retire on 30th June, 2015, and<br \/>\ntherefore, the option exercised by the petitioner in the year 2004 has been<br \/>\nexercised as per the requirement of the said Government Order dated<br \/>\n25.8.1999.\n<\/p>\n<p>We may mention that in Civil Misc. Writ Petition No. 13169 of 2008 (Kirti<br \/>\nChand Gupta and others Vs. State of U.P. and others) connected with<br \/>\nvarious other Writ Petitions, similar controversy was involved. A Division<\/p>\n<p>Bench of this Court by its Judgment and Order dated 16th April, 2009<br \/>\n(Annexure 10 to the Writ Petition) decided the said Writ Petitions following<br \/>\nthe decision of this Court in Dr. Shri Gopal Gupta (supra), and gave<br \/>\ndirections to the respondents in the said Writ Petitions for extending the<\/p>\n<p>benefit of the said Government Order dated 25th August, 1999 to the<br \/>\npetitioners in the said Writ Petitions.\n<\/p>\n<p>Respectfully following the above decisions, we decide the present Writ<br \/>\nPetition giving similar directions.\n<\/p>\n<p>The Writ Petition is accordingly allowed.\n<\/p>\n<p>The respondents are directed to give benefit of the Government Order dated<\/p>\n<p>25th August, 1999 in terms of the option exercised by the petitioner within<br \/>\nthree months of the filing of the certified copy of this Order before the<br \/>\nDirector of Higher Education, Uttar Pradesh, Allahabad.<br \/>\n On the facts and in the circumstances of the case, the parties will bear their<br \/>\nown costs.\n<\/p>\n<p>Order Date :- 27.1.2010<br \/>\nAjeet\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Dr. Smt.
