Justice K.HEMA\n\n Dated :19\/09\/2008\n\n O R D E R\n                              K.HEMA, J.\n                 -------------------------------------------------\n                          B.A.No.5684 of 2008\n                 -------------------------------------------------\n           Dated this the 19th day of September, 2008\n\n\n\n                                 O R D E R\n<\/pre>\n<p>      This petition is for anticipatory bail.\n<\/p>\n<p>      2.   The alleged offence is under Section 55(i) of Abkari<\/p>\n<p>Act. According to prosecution, petitioner and the fourth accused<\/p>\n<p>are running a hotel by name Sreekrishna and on inspection of<\/p>\n<p>the hotel, 37 bottles of Indian made foreign liquor containing a<\/p>\n<p>total quantity of 30 litres were seized. The first and the second<\/p>\n<p>accused who were present at the hotel were arrested from the<\/p>\n<p>spot. On the confession made by them, petitioner and the fourth<\/p>\n<p>accused were also brought into the array of accused.<\/p>\n<p>      3.   Learned counsel for the petitioner submitted that<\/p>\n<p>fourth accused is the owner of the building and petitioner is his<\/p>\n<p>nephew. As per Annexure AI agreement, hotel is run by the<\/p>\n<p>second accused and it is the second accused who deliberately<\/p>\n<p>implicated the petitioner, who has nothing to do with the<\/p>\n<p>building, it is submitted. It is also pointed out that even as per<\/p>\n<p>the allegations, petitioner was not present anywhere near the<\/p>\n<p><span class=\"hidden_text\">BA No.5684\/08                    2<\/span><\/p>\n<p>spot at the time of offence.\n<\/p>\n<p>     4.    This petition is opposed. Learned public prosecutor<\/p>\n<p>conceded that according to prosecution, the petitioner was not<\/p>\n<p>present at the spot and that no licence was issued to anybody to<\/p>\n<p>conduct hotel. Petitioner was implicated only by the confession<\/p>\n<p>made by the first and the second accused. There is no licence for<\/p>\n<p>running a hotel to anybody.\n<\/p>\n<p>     5.    On hearing both sides, I find that except the<\/p>\n<p>confession made by the first and the second accused, there is<\/p>\n<p>nothing to connect petitioner with the crime.       The property<\/p>\n<p>belongs to fourth accused and Annexure AI prima facie shows<\/p>\n<p>that the hotel is run by the second accused and he was arrested<\/p>\n<p>from spot. In the above circumstances, I find that anticipatory<\/p>\n<p>bail can be granted to the petitioner.\n<\/p>\n<p>     Hence, the following order is passed:\n<\/p>\n<p>       (1) Petitioner shall surrender before the Investigating<\/p>\n<p>           Officer within seven days from today and he shall<\/p>\n<p>           subject himself to interrogation.\n<\/p>\n<p>      (2) Thereafter, he shall be released on bail in the event of<\/p>\n<p>           his arrest on his executing bond for Rs.25,000\/- with<\/p>\n<p><span class=\"hidden_text\">BA No.5684\/08                    3<\/span><\/p>\n<p>           two solvent sureties each for the like sum to the<\/p>\n<p>           satisfaction of the arresting officer on the following<\/p>\n<p>           conditions:\n<\/p>\n<blockquote><p>               (i)    He shall report before the Investigating<\/p>\n<p>                      Officer as and when directed.<\/p>\n<\/blockquote>\n<blockquote><p>               (ii)   He shall co-operate with the investigation<\/p>\n<p>                      as and when directed.\n<\/p><\/blockquote>\n<blockquote><p>               (iii)  He shall not commit any offence while on<\/p>\n<p>                      bail.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<p>        The petition is allowed.\n<\/p>\n<\/p>\n<p>                                               K.HEMA, JUDGE<br \/>\ncsl<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Abhilash (Abhish) vs Excise Inspector on 19 September, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 5684 of 2008() 1.
