That impugned order dated 27.01.2007 is<br \/>\nissued by Police Commissioner, Vadodara in exercise of his powers<br \/>\nconferred under the provisions of section 3 of the Gujarat Prevention<br \/>\nof Anti-Social Activities Act, 1985 (&#8220;PASA&#8221; for short)  on<br \/>\nthe basis that the petitioner was found to be repeatedly indulging in<br \/>\nanti-social activity of bootlegging and an offence being III-C.R.No.6<br \/>\nof 2007 under the Prohibition Act was registered on 07.01.2007<br \/>\nagainst the petitioner in Jawaharnagar Police Station of Vadodara.<br \/>\nAccording to the grounds of detention supplied with the impugned<br \/>\norder, even as the aforesaid offence was being investigated, other<br \/>\nactions under the Prohibition Act were not possible and alcohol being<br \/>\ninjurious to health, there was likelihood of danger to public health<br \/>\non account of consumption of illicit liquor in which the petitioner<br \/>\nwas dealing.  It is further stated that possibility of the petitioner<br \/>\ncontinuing in anti-social activities could not be denied and hence it<br \/>\nwas found to be necessary to detain the petitioner after considering<br \/>\nthe documents and statements which were relied upon and supplied to<br \/>\nthe petitioner.\n<\/p>\n<p>2.\t\tEven<br \/>\nas the present petition was admitted on 08.02.2007 and Rule was made<br \/>\nreturnable on 10.5.2007 and an affidavit-in-reply of the detaining<br \/>\nauthority was ready and executed on 21.5.2007, it was submitted to<br \/>\nthis court and copy thereof supplied to the petitioner on 9.7.2007.<br \/>\nIt is stated in that affidavit, inter alia, that prima<br \/>\nfacie involvement of the petitioner was established in the<br \/>\noffence registered against her.  It is further stated: &#8220;I say<br \/>\nand submit that sufficient documentary evidence is available to<br \/>\nestablish that the petitioner is involved in the bootlegging<br \/>\nactivities. I say  and submit that the petitioner is doing his<br \/>\nbootlegging activities in a sequence. I say and submit that the<br \/>\nliquor is  injurious to health and likely to create health hazard in<br \/>\ngeneral public and, thus, the public order has been disturbed. I say<br \/>\nand submit that after verifying the documents placed before me, the<br \/>\norder of detention is passed and the petitioner has been detained<br \/>\nunder the provisions of section 2 (b)  of PASA as &#8220;Bootlegger&#8221;,<br \/>\ntherefore, I passed the order of detention, which is  legal, just and<br \/>\nproper&#8221;.\n<\/p>\n<p>3.\t\tIn the above facts,<br \/>\nit was sought to be argued on behalf of the respondents that danger<br \/>\nto public health caused by the activity of bootlegging by the<br \/>\npetitioner substantiated the assumption of likelihood of public order<br \/>\nbeing adversely affected and, for that reason, the subjective<br \/>\nsatisfaction about the necessity of preventing the petitioner from<br \/>\nacting in any manner prejudicial to the maintenance of public order<br \/>\nand the impugned order directing his detention were legal and<br \/>\njustified.\n<\/p>\n<p>4.\t\tAs<br \/>\nheld by this court in <a href=\"\/doc\/1908459\/\">Amarbhai Kanjibhai Nayak v. Commissioner<br \/>\nof Police, Ahmedabad City &amp; Ors.<\/a> [1993 (3) G.L.R. 2703]<br \/>\nand in <a href=\"\/doc\/702717\/\">Sohanlal Surajaram  Visnoi v. State of Gujarat<\/a>   [2004<br \/>\n(2) G.L.R. 1051], \tsolitary incident of violation of<br \/>\nprohibition law, normally, without anything more, would not be a<br \/>\nproblem to the maintenance of public order and, for such solitary<br \/>\nincident, no person can be detained under the Act.  It was also seen<br \/>\nfrom analysis of the provisions of sub-section (4) of section 3 and<br \/>\nthe Explanation appended thereto that the presumption of likelihood<br \/>\nof public order being adversely affected could arise, if danger were<br \/>\ncaused to life or public health, but such danger has to be grave or<br \/>\nwidespread for the mandatory presumption of likelihood of public<br \/>\norder being adversely affected.  In the facts of the present case,<br \/>\nnothing from the material on record could substantiate or justify the<br \/>\npresumption of grave or widespread danger to life or public health<br \/>\nand hence, the presumption of likelihood of public order being<br \/>\nadversely affected could not have been legally availed by the<br \/>\ndetaining authority for the purpose of arriving at a subjective<br \/>\nsatisfaction.\n<\/p>\n<p>5.\t\tTherefore,<br \/>\nin the facts and circumstances, the impugned order dated 27.01.2007<br \/>\nof preventive detention is found and held to be unsustainable in law<br \/>\nand set aside with the direction that the petitioner shall be set at<br \/>\nliberty forthwith unless required to be detained in connection with<br \/>\nany other case.  Rule is made absolute accordingly.
