Justice M.SASIDHARAN NAMBIAR\n\n Dated :02\/11\/2009\n\n O R D E R\n             M.Sasidharan Nambiar, J.\n            --------------------------\n              Crl.M.C.No.3066 of 2009\n            --------------------------\n\n                       ORDER\n<\/pre>\n<p>    Petitioners are counter petitioners in M.C.No.<\/p>\n<p>38\/2009 on the file of Sub Divisional Magistrate,<\/p>\n<p>Ottapalam, initiated under Section 107 of Code of<\/p>\n<p>Criminal Procedure. Annexure-A1 order was passed<\/p>\n<p>under Section 111 of Code of Criminal Procedure<\/p>\n<p>stating that Sub Divisional Magistrate is satisfied<\/p>\n<p>by the report of Sub Inspector of Police, Nattukal<\/p>\n<p>that petitioners are creating a tense situation and<\/p>\n<p>there  is   likelihood  of   further  clashes   and<\/p>\n<p>disturbance to the public living in the area and<\/p>\n<p>hence, petitioners are directed to execute a bond,<\/p>\n<p>for keeping peace and public tranquility in the<\/p>\n<p>area, worth Rs.20,000\/- (Rupees Twenty thousand<\/p>\n<p>only) with two sureties for the like sum and to<\/p>\n<p>appear before the court on 5.8.2009 and show cause<\/p>\n<p>why they shall not execute the bond. This petition<\/p>\n<p>is filed under Section 482 of Code of Criminal<\/p>\n<p><span class=\"hidden_text\">CRMC 3066\/09              2<\/span><\/p>\n<p>Procedure to quash the proceedings contending that<\/p>\n<p>continuation of the proceedings is only an abuse of<\/p>\n<p>process of the court.\n<\/p>\n<p>    2. Learned counsel appearing for the petitioners<\/p>\n<p>and learned Public Prosecutor were heard.<\/p>\n<p>    3. Though action was taken under Section 107 of<\/p>\n<p>Code of Criminal Procedure, based on the report of<\/p>\n<p>Sub Inspector of Police, Nattukal, it is clear from<\/p>\n<p>Annexure-A1   order  that  the  allegations against<\/p>\n<p>petitioners were that they are involved in Crime<\/p>\n<p>Nos.87\/2009 and 92\/2009 of Nattukal Police Station<\/p>\n<p>and Crime No.259\/2009 of Mannarkad Police Station.<\/p>\n<p>Copy of FIR in Crime No.87\/2009 made available by<\/p>\n<p>the learned counsel appearing for the petitioners<\/p>\n<p>shows that the case was registered on 3.5.2009<\/p>\n<p>based on the F.I. Statement of the brother of the<\/p>\n<p>deceased father of the petitioners. The allegation<\/p>\n<p>is that on 29.4.2009 at about 9.30 p.m. the accused<\/p>\n<p>therein trespassed into the rubber estate of the<\/p>\n<p>first   informant  and  committed theft   of rubber<\/p>\n<p><span class=\"hidden_text\">CRMC 3066\/09              3<\/span><\/p>\n<p>sheets and thereby committed the offences under<\/p>\n<p>Sections 447, 506(1) and 379 read with Section 34<\/p>\n<p>of Indian Penal Code. FIR in Crime No.259\/2009 made<\/p>\n<p>available shows that that case was also registered<\/p>\n<p>based on the F.I. Statement of the same person,<\/p>\n<p>wherein, it is alleged that on the morning at 6.30<\/p>\n<p>a.m.   of   29.4.2009, petitioners trespassed  into<\/p>\n<p>another estate of the first informant and committed<\/p>\n<p>theft of latex and thereby committed offences under<\/p>\n<p>Sections 447, 506(1) and 379 read with Section 34<\/p>\n<p>of Indian Penal Code. FIR in Crime No.92\/2009 made<\/p>\n<p>available shows that that case was registered on<\/p>\n<p>11.5.2009,   based  on a   private complaint  filed<\/p>\n<p>before Judicial First Class Magistrate&#8217;s Court,<\/p>\n<p>Mannarkad by the son of the first informant in the<\/p>\n<p>other cases, against petitioners 2, 4, 7 and 8<\/p>\n<p>alleging    that   they committed  offences   under<\/p>\n<p>Sections 323 and 324 read with Section 34 of Indian<\/p>\n<p>Penal Code by assaulting the son of the first<\/p>\n<p>informant in other cases on 23.11.2008. C.M.P.<\/p>\n<p><span class=\"hidden_text\">CRMC 3066\/09             4<\/span><\/p>\n<p>No.995\/2009, which was sent for investigation, was<\/p>\n<p>filed    before the  learned  Magistrate  only   on<\/p>\n<p>5.5.2009, though the alleged incident occurred on<\/p>\n<p>23.11.2008.\n<\/p>\n<p>    4. Learned Public Prosecutor submitted that<\/p>\n<p>apart from these three cases, there was no other<\/p>\n<p>case of breach of peace committed by petitioners.<\/p>\n<p>As rightly pointed out by the learned counsel<\/p>\n<p>appearing for the petitioners, it is clear that<\/p>\n<p>action was taken because of the pendency of the<\/p>\n<p>civil dispute between the petitioners and the first<\/p>\n<p>informant and his son in Crime Nos.87\/2009 and<\/p>\n<p>259\/2009.    The dispute is  with  regard  to   the<\/p>\n<p>property left behind by the father of the first<\/p>\n<p>informant in Crime No.87\/2009 and petitioners, who<\/p>\n<p>are the children of the pre-deceased brother of the<\/p>\n<p>first informant. In the nature of the allegations<\/p>\n<p>and taking into account the fact that Crime Nos.<\/p>\n<p>87\/2009 and 259\/2009 were in respect of an incident<\/p>\n<p>occurred on the morning and night of 29.4.2009 and<\/p>\n<p><span class=\"hidden_text\">CRMC 3066\/09              5<\/span><\/p>\n<p>Crime No.92\/2009 was in respect of an alleged<\/p>\n<p>incident    which took  place  on  23.11.2008,   but<\/p>\n<p>complaint was lodged only on 11.5.2009, it is clear<\/p>\n<p>that facts and circumstances of the case do not<\/p>\n<p>warrant initiation of proceedings under Section 107<\/p>\n<p>of    Code    of  Criminal   Procedure.   In    such<\/p>\n<p>circumstances, the proceedings is to be quashed.<\/p>\n<p>     Petition is allowed.
