Respondents No.1, 2, 4,<br \/>\n\tand 9 are served.  Mr.Pandya, learned AGP appears for respondent<br \/>\n\tNo.3 and Mr.S.N. Thakkar, learned Counsel appears for respondent<br \/>\n\tNo.7 and he states that he has no objection if the amount is<br \/>\n\tpermitted to be withdrawn to the applicant.\n<\/p>\n<p>Mr.Shah,<br \/>\n\tlearned Counsel for the applicant further states that Mr.Dharmesh V.<br \/>\n\tShah, who is appearing for respondent No.8 has conveyed to him that<br \/>\n\tSuryapur Cooperative Bank Limited has no objection for such<br \/>\n\twithdrawal.\n<\/p>\n<p>The<br \/>\n\tbasis of the present application is the settlement arrived at<br \/>\n\tbetween the applicant Bank and Doshi Chemicals Pvt. Ltd., respondent<br \/>\n\tNo.1 and Pragati Alcochem Pvt. Ltd., respondent No.7. A copy of the<br \/>\n\tsettlement is produced on record.\n<\/p>\n<p>Further,<br \/>\n\tthe learned Counsel for the applicant has placed on record a copy of<br \/>\n\tthe order dated 22.3.2010 passed by the Apex Court in Special Leave<br \/>\n\tto Appeal (C) Nos.11898-11902 of 2007, wherein<br \/>\n\tthe following has been passed :-\n<\/p>\n<p>&#8221;\tSubsequent<br \/>\n\tto the impugned order, parties have entered into a Memorandum of<br \/>\n\tUnderstanding (MoU) on 5th February, 2010. Since the MoU<br \/>\n\tcontemplates sale of the assets, nothing survives in these Special<br \/>\n\tLeave Petitions, except to take the MoU on record.  The MoU is,<br \/>\n\taccordingly, taken on record.  Sale to be conducted in terms of the<br \/>\n\tMoU.\n<\/p>\n<p>\t\t\t\tSpecial<br \/>\n\t\t\tLeave Petitions are disposed of in terms of the MoU.\n<\/p>\n<p>Receiver<br \/>\n\t\t\tto be paid a further amount of Rs.10,000\/- towards his fees and<br \/>\n\t\t\the, accordingly, stands discharged.&#8221;\n<\/p>\n<p>The<br \/>\n\taforesaid shows that the Special Leave Petitions stand<br \/>\n\tdisposed of.  The learned Counsel for the applicant states that the<br \/>\n\tMoU is the same, which is produced before this Court in the<br \/>\n\tproceedings of the present application on page 14.  As per Clause<br \/>\n\tNo.2 of MoU, the amount of Rs.20 lac is lying with this Court to be<br \/>\n\tgiven to the applicant bank, upon agreement by respondent No.1 and<br \/>\n\tother parties to give consent.  The authority letter is also<br \/>\n\tproduced on page 12.\n<\/p>\n<p>No<br \/>\n\tother adverse circumstances are brought to the notice of this Court.\n<\/p>\n<p>Under<br \/>\n\tthese circumstances, the applicant shall be permitted withdrawal of<br \/>\n\tRs.20 lac on production of &#8216;No Objection&#8217; letter from Mr.Dharmesh V.<br \/>\n\tShah for respondent No.8.
