SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 01\/10\/2010 \n\n \n\n \nORAL\nJUDGMENT<\/pre>\n<p>By<br \/>\n\tway of this petition under Article 227 of the Constitution of India,<br \/>\n\tthe petitioner  has<\/p>\n<p>\tprayed for appropriate writ, order and\/or direction quashing and<br \/>\n\tsetting aside the impugned<br \/>\n\torder<br \/>\n\tdtd.8\/10\/2003 passed by<br \/>\n\tthe Appellate  Industrial Court, Nadiad in  Appeal (ICN) No.9 of<br \/>\n\t2002, by which the appellate court has partly allowed the said<br \/>\n\tappeal directing the petitioner  herein to reinstate<br \/>\n\tthe respondent workman as a Clerk with continuity of service but<br \/>\n\twithout back-wages  or other monetary benefits.\n<\/p>\n<p>Though<br \/>\n\tserved nobody appears on behalf  of  the respondent workman.\n<\/p>\n<p>It<br \/>\n\tappears from the affidavit filed by the petitioner<br \/>\n\tdtd.179\/2008 that the respondent shall not be interested in the<br \/>\n\tpresent litigation, as he is already working in the Income<br \/>\n\tDepartment and is gainfully employed and he might not be interested<br \/>\n\tin appointment as a Clerk in the petitioner Bank.\n<\/p>\n<p>Having<br \/>\n\theard Mr.Gadhia, learned<br \/>\n\tadvocate appearing on behalf of the petitioner  and<br \/>\n\tconsidering the judgement and order dtd.31\/7\/2001  passed by the<br \/>\n\tLabour Court, Nadiad  in T-Application No.9 of 1992  as well as the<br \/>\n\torder dtd. 8\/10\/2003<br \/>\n\tpassed by the Appellate  Industrial Court, Nadiad in  Appeal (ICN)<br \/>\n\tNo.9 of 2002, it appears that the appointment of the respondent as a<br \/>\n\tClerk  was a training, initially for a period of six months, which<br \/>\n\twas extended for a further period of six months and that thereafter<br \/>\n\ton completion of training period, he was relieved.\n<\/p>\n<p>Considering<br \/>\n\tthe above the case squarely falls within sec.2(oo)(bb) of the<br \/>\n\tIndustrial Disputes Act, 1947. Under the circumstances, the<br \/>\n\tIndustrial Court has materially erred in allowing the appeal<br \/>\n\tpreferred by the respondent workman and directing the petitioner<br \/>\n\temployer to reinstate the respondent workman  on the<br \/>\n\tpost of Clerk with continuity of service.\n<\/p>\n<p>In<br \/>\n\tview of the above and for the reasons stated above, present petition<br \/>\n\tsucceeds. The impugned order<br \/>\n\tdtd.8\/10\/2003 passed by the Appellate  Industrial Court, Nadiad in<br \/>\n\tAppeal (ICN) No.9 of 2002 is hereby quashed and set aside and the<br \/>\n\tjudgement and order<br \/>\n\tdtd.31\/7\/2001 passed by the Labour Court, Nadiad  in T-Application<br \/>\n\tNo.9 of 1992<br \/>\n\tis hereby restored.
