KOSHY, J.\n<\/p>\n<p>                &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-<br \/>\n               Crl.R.P. NO. 318 of 2000\n<\/p>\n<p>                &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-<br \/>\n     Dated this the 26th day of September, 2007<\/p>\n<p>                          Order<\/p>\n<p>         Petitioner was convicted and sentenced to<\/p>\n<p>undergo  simple  imprisonment       for    one  month  under<\/p>\n<p>sections 279 and 337 and simple imprisonment for two<\/p>\n<p>months under section 338 of the Indian Penal Code by<\/p>\n<p>the Magistrate&#8217;s court.       In appeal, the conviction<\/p>\n<p>was confirmed, but, sentence was modified.         Operative<\/p>\n<p>portion of the appellate judgment is as follows:<\/p>\n<blockquote><p>             &#8220;a) This appeal is allowed in<br \/>\n         part.\n<\/p><\/blockquote>\n<blockquote><p>             b)  The    verdict      of    guilty and<br \/>\n         conviction imposed on the appellant<br \/>\n         u\/s.279, 337 and 338 IPC are upheld.<\/p><\/blockquote>\n<pre>\n\n             c) But the sentence imposed on\n         the   appellant       is      modified   and\n         reduced.     In    supersession      of  the\n<\/pre>\n<blockquote><p>         sentence imposed on the appellant by<br \/>\n         the   learned      Magistrate,       he   is<br \/>\n         sentenced u\/s. 338 IPC to undergo<br \/>\n         S.I. for a period of 14 days and to<br \/>\n         pay a fine of Rs.1,000\/-.          In default<br \/>\n         of payment of fine he shall undergo<br \/>\n         S.I. for further period of 10 days.<br \/>\n         He is further sentenced u\/s. 279 and<br \/>\n         337 IPC to pay a fine of Rs.1,000\/-<\/p><\/blockquote>\n<p>         and   Rs.500\/-      respectively.         In<\/p>\n<p>Crl.RP.No.318\/2000<br \/>\n<span class=\"hidden_text\">                             : 2 :<\/span><\/p>\n<p>             default of payment of fine, he shall<br \/>\n             undergo S.I. for a further period of<br \/>\n             2 weeks and one week respectively.<\/p>\n<p>                  d)  The   appellant  is   further<br \/>\n             disqualified from driving any class<br \/>\n             of   vehicles for    a period of  six<br \/>\n             months from the date of endorsement.&#8221;<\/p>\n<p>The allegation was that on 6.8.1996 at 8.15 p.m. the<\/p>\n<p>revision petitioner drove bus KL\/8D 6066 through<\/p>\n<p>Palakkad-Thrissur national highway in a rash and<\/p>\n<p>negligent manner at an excessive speed endangering<\/p>\n<p>human     life.     The  bus  driven  by  the  petitioner<\/p>\n<p>allegedly went and hit at the rear of lorry No.TN\/37<\/p>\n<p>3492 which was parked on the southern side of the<\/p>\n<p>road causing injuries to passengers in the bus driven<\/p>\n<p>by the petitioner.       PW1 is a passenger who sustained<\/p>\n<p>fracture of distal phalanx of left thumb.        PW1 who<\/p>\n<p>gave first information statement became hostile and<\/p>\n<p>stated that he is not aware as to who was driving the<\/p>\n<p>lorry and he does not know what happened.            PW2,<\/p>\n<p>another injured witness, stated that accused was<\/p>\n<p>driving the bus with over speed and it hit a lorry on<\/p>\n<p>the back side.       According to him, the lorry was not<\/p>\n<p>Crl.RP.No.318\/2000<br \/>\n<span class=\"hidden_text\">                              : 3 :<\/span><\/p>\n<p>parked.      It was also running.    According to PW3, the<\/p>\n<p>bus hit on a stationed lorry.         The lorry was parked<\/p>\n<p>on the left side.         He also stated that there was<\/p>\n<p>drizzling and darkness.      Doctor was examined to prove<\/p>\n<p>the injury.       Evidence of PW2 was mainly believed by<\/p>\n<p>the court and found that the accused was driving the<\/p>\n<p>bus in a rash and negligent manner so as to endanger<\/p>\n<p>human life.       Appellate court upheld the finding and<\/p>\n<p>though      confirmed    the    conviction,   altered   the<\/p>\n<p>sentence.        I am of the view that there was drizzling<\/p>\n<p>and darkness.        The lorry was parked without park<\/p>\n<p>light.     In    the above  circumstances,   though   I  am<\/p>\n<p>confirming the conviction, I am altering the sentence<\/p>\n<p>imposed.          The sentence imposed on the petitioner<\/p>\n<p>under section 338 to undergo           simple imprisonment<\/p>\n<p>or a period of 14 days is set aside, but, he is<\/p>\n<p>sentenced to pay a fine of Rs. 1,000\/- as ordered.<\/p>\n<p>No other modification of the sentence is necessary.<\/p>\n<p>Conviction        and  sentence    are   confirmed   except<\/p>\n<p>conviction and sentence of simple imprisonment for 14<\/p>\n<p>days under section 338 IPC.
