PANKAJ SINGH, S\/O- AMBIKA SINGH\n              BOTH RESIDENTS OF VILLAGE- NEYA, P.S.- MUFASSIL,\n              DISTRICT- NAWADAH.\n                                             Versus\n                                   THE STATE OF BIHAR\n         For the petitioners     : Mr. Pramod Mishra, Advocate.\n         For the State           : Mr. Mukeshwar Dayal, APP\n                                           -----------\n<\/pre>\n<p>2   08.04.2011                After hearing both the sides, this Court is<\/p>\n<p>                 satisfied that matter requires consideration only on the<\/p>\n<p>                 question of sentence.\n<\/p>\n<p>                              Hence Rule confined to question of sentence<\/p>\n<p>                 only.\n<\/p>\n<p>                              Learned A.P.P. waives notice on behalf of the<\/p>\n<p>                 State.\n<\/p>\n<p>                              With the consent of the parties, the application<\/p>\n<p>                 is being finally disposed of at this stage.<\/p>\n<p>                              Petitioners herein are father and son. They are<\/p>\n<p>                 aggrieved by the judgment dated 13.1.2011 passed in Cr.<\/p>\n<p>                 Appeal No.     22\/2001\/13\/2010 by learned Addl. Sessions<\/p>\n<p>                 Judge-cum-Fast Track Court No. II, Nawada whereby the<\/p>\n<p>                 appeal preferred by the petitioners stood dismissed with<\/p>\n<p>                 modification in sentence. For an occurrence that had taken<\/p>\n<p>                 place on 7.9.1998 , petitioners herein along with some other<\/p>\n<p>                 accused persons were put on trial vide Tr. No. 1110\/2001.<\/p>\n<p>                 Four witnesses were examined on behalf of the complainant<\/p>\n<p>                 (P.W. 2). The three injureds namely P.Ws. 1, 2 and 3<br \/>\n<span class=\"hidden_text\">                        2<\/span><\/p>\n<p>supported the prosecution case. On a consideration of the<\/p>\n<p>materials on record, learned Trial Court found and held them<\/p>\n<p>guilty under Sections 147, 323 and 452 of Indian Penal<\/p>\n<p>Code and sentenced to undergo R.I. for 01 years, R.I. for 06<\/p>\n<p>months and R.I. for 02 years respectively. Aggrieved over<\/p>\n<p>the aforesaid judgment and order of conviction, they<\/p>\n<p>preferred appeal which was dismissed with modification in<\/p>\n<p>sentence. Learned Appellate Court concurred with the<\/p>\n<p>findings of guilt recorded by the learned Trial Court.<\/p>\n<p>However the sentence awarded under Sections 147, 323<\/p>\n<p>and 452 of Indian Penal Code was\/were reduced to fine of<\/p>\n<p>Rs. 500\/-, fine of Rs. 1000\/- and R.I. for 06 months with fine<\/p>\n<p>having default clause respectively.\n<\/p>\n<p>               Learned counsel submits that admittedly the<\/p>\n<p>occurrence had taken place on account of land dispute as<\/p>\n<p>has been admitted in the complaint. The said occurrence<\/p>\n<p>had taken place on 7.9.1998. The trial of the petitioner<\/p>\n<p>consumed over three years. The appeal thereafter remained<\/p>\n<p>pending for 09 years. It is submitted that fighting criminal<\/p>\n<p>litigation   for   a   long   time   and   thereby   to   undergo<\/p>\n<p>rigours\/ordeal thereof is a shade of punishment which need<\/p>\n<p>to be kept in focus. It is submitted that petitioner No. 1 was<\/p>\n<p>found aged about 62 years at the time of recording<\/p>\n<p>conviction. It is said that he is now close to 70 years of age.<\/p>\n<p>               Learned APP, on the other hand, submits that<br \/>\n<span class=\"hidden_text\">                    3<\/span><\/p>\n<p>there is\/are concurrent findings of guilt recorded by the two<\/p>\n<p>Courts below which have not been shown to be perverse<\/p>\n<p>meriting interference on merit. It is submitted that reasons<\/p>\n<p>have been assigned by learned Trial Court for not giving the<\/p>\n<p>petitioner benefit of the provisions under Section 360 of the<\/p>\n<p>Code.\n<\/p>\n<p>            I have considered the submissions made on<\/p>\n<p>behalf of the parties and perused the two judgments<\/p>\n<p>impugned in this proceeding. It is obvious from the materials<\/p>\n<p>on record that for more than three years, the petitioner had<\/p>\n<p>to undergo rigours of trial. Petitioner No. 1 was found aged<\/p>\n<p>about 62 years at the time of conviction. It appears from<\/p>\n<p>Trial Court judgment that they are the first convicts.<\/p>\n<p>Occurrence had taken place on account of bona fide land<\/p>\n<p>dispute between the parties. Considering all these aspects<\/p>\n<p>of the matter, this Court is satisfied that they deserve<\/p>\n<p>consideration on the question of the sentence.<\/p>\n<p>            Accordingly, while upholding the conviction<\/p>\n<p>recorded by the learned Trial Court and duly affirmed by<\/p>\n<p>learned Lower Appellate Court, the sentence awarded to the<\/p>\n<p>petitioners by learned Appellate Court is reduced as under:<\/p>\n<blockquote><p>            (i)    Petitioner No. 1 shall undergo R.I. for 02<\/p>\n<p>                   months under Section 452 of Indian<\/p>\n<p>                   Penal Code. Other part\/conditions of<\/p>\n<p>                   sentence shall remain intact\/unaltered.<br \/>\n<span class=\"hidden_text\">                          4<\/span><\/p>\n<\/blockquote>\n<blockquote><p>                  (ii)   Petitioner no. 2 shall undergo R.I. for 04<\/p>\n<p>                         months under Section 452 of Indian<\/p>\n<p>                         Penal Code. Other part(s)\/condition(s) of<\/p>\n<p>                         the        sentence          shall   remain<\/p>\n<p>                         intact\/unaltered.\n<\/p><\/blockquote>\n<blockquote><p>                  With    this    modification   in    sentence,   the<\/p>\n<p>      application is dismissed.<\/p><\/blockquote>\n<p>                             ( Kishore K.
