Advocate\n\nHon'ble Vijay Manohar Sahai,J.\n<\/pre>\n<p>Hon&#8217;ble Vikram Nath,J.\n<\/p>\n<p>Heard learned counsel for the petitioner and learned A.G.A.\n<\/p>\n<p>By means of this petition filed under Article 226 of the<br \/>\nConstitution of India, challenge has been made to the notice dated<br \/>\n21.5.2010 issued by respondent no. 2 under Section 3(1) of U.P.<br \/>\nControl of Goondas Act (hereinafter referred to as &#8216;the Act&#8217;).\n<\/p>\n<p>It is contended by learned counsel for the petitioner that since the<br \/>\nnotice issued by the District Magistrate does not contain the<br \/>\nmaterial allegations on the basis of which he formed his opinion as<br \/>\nsuch it does not meet the requirement and is not in accordance<br \/>\nwith Section 3(1) of the Act. Reliance in support of the contention<br \/>\nhas been placed on two Full Bench judgements of this Court in the<br \/>\ncase of <a href=\"\/doc\/1886101\/\">Ramji Pandey vs. State of U.P.,<\/a> 1981 Cri..L.J. 1083, <a href=\"\/doc\/596731\/\">Bhim<br \/>\nSien Tyagi vs. State of U.P.,<\/a> 1999(2) JIC 192 (Alld.) and the<br \/>\nDivision Bench in the case of Raj Kumar Dubey vs. State of U.P.<br \/>\n&amp; others, [2009(3) ADJ 361(DB)].\n<\/p>\n<p>Learned A.G.A. has, however, tried to justify the impugned notice<br \/>\nby stating that in the notice subjective satisfaction has been<br \/>\nrecorded by the District Magistrate on the ground the activities of<br \/>\nthe petitioner is dangerous to the general public and there is reason<br \/>\nto believe that he can commit any offence under Part-16, 17 &amp; 22<br \/>\nI.P.C. and thus the notice meets the requirement of Section 3(1) of<br \/>\nthe Act.\n<\/p>\n<p>We have considered the argument advanced by learned counsel for<br \/>\nthe parties.\n<\/p>\n<p>In the case of Ramji Pandey (Supra), it has been held by the Full<br \/>\nBench that although the expression material allegations has not<br \/>\nbeen defined by that Act, according to the dictionary meanings, the<br \/>\nword material means important and essential, of significance. The<br \/>\n word allegation means statement or assertion of facts. Thus the<br \/>\nnotice under Section 3(1) should contain the essential assertions of<br \/>\nfacts in relation to the matters set out in clauses (a), (b) and of sub-<br \/>\nsection (1) of Section 3 of the Act. It need not refer to any<br \/>\nevidence or other particulars or details.\n<\/p>\n<p>A bare perusal of the impugned notice filed as annexure-1 to the<br \/>\nwrit petition goes to show that case crime number and sections<br \/>\nunder which the petitioner has been challaned have been<br \/>\nmentioned but the assertions of the broad particulars which are<br \/>\nrequired to be mentioned with regard to each of the cases, have not<br \/>\nbeen mentioned in the notice.\n<\/p>\n<p>We do not find that the impugned notice conforms to the<br \/>\nrequirement of Section 3(1) of the Act inasmuch as it does not<br \/>\ncontain the material allegations even of general nature on the basis<br \/>\nof which the District Magistrate can be said to have formed his<br \/>\nopinion.\n<\/p>\n<p>The law on the point being settled by two Full Bench decisions<br \/>\nreferred above, the impugned notice does not conform to the<br \/>\nmandatory provision of Section 3(1) of the Act and cannot be<br \/>\nsustained and is hereby quashed.\n<\/p>\n<p>The petition stands allowed.\n<\/p>\n<p>It shall, however, be open to the Upper District Magistrate,<br \/>\nKaushambi to issue a fresh notice in accordance with law.\n<\/p>\n<p>Order Date :- 15.6.2010<br \/>\nRam Murti\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Nanhoo vs State Of U.P. &amp; Anr. on 15 June, 2010 Court No. &#8211; 9 Case :- CRIMINAL MISC.
