                                     The matter was adjourned on 16-8-2010 to<\/p>\n
                         enable the counsel for the appellant to find out as to<\/p>\n
                         whether the appellant was willing to offer a reasonable<\/p>\n
                         and acceptable amount of permanent alimony because on<\/p>\n
                         our persuasion the respondent, who had appeared along<\/p>\n
                         with her counsel on the last date, had agreed that in the<\/p>\n
                         interest of all concerned and for education of her son,<\/p>\n
                         who is now aged about 12 years, she can give her<\/p>\n
                         consent for divorce provided the appellant is willing to<\/p>\n
                         offer a reasonable and decent lumpsum amount by way<\/p>\n
                         of permanent alimony.\n<\/p>\n
                                     It is a matter of satisfaction that today the<\/p>\n
                         appellant has offered to pay a lumpsum alimony of Rs.<\/p>\n
                         12.5 lacs to the respondent if she agrees for a divorce by<\/p>\n
                         consent. According to the appellant the respondent will<\/p>\n
                         be paid Rs. 5 lacs within one week and the balance<\/p>\n
                         amount of Rs. 7.5 lacs will be paid to her within a period
\n                   2<\/span><\/p>\n
of six months from today. It was suggested on behalf of<\/p>\n
the appellant that on account of good sense prevailing<\/p>\n
amongst the parties the criminal case lodged by the<\/p>\n
respondent   should    also   be   either   withdrawn   or<\/p>\n
compromised as that is a complaint case within the<\/p>\n
control of the respondent.\n<\/p>\n
          On behalf of respondent the aforesaid offer has<\/p>\n
been accepted and as a result the respondent has<\/p>\n
expressed her consent for awarding a decree of divorce<\/p>\n
on mutual consent.\n<\/p>\n
          We had heard the parties earlier and had found<\/p>\n
that although the respondent was willing to live with<\/p>\n
appellant and maintain the matrimonial ties but the<\/p>\n
appellant for some reason had been unable to give the<\/p>\n
marriage another chance. From the facts it was clear that<\/p>\n
the marriage has broken down irretrievably. In such<\/p>\n
circumstances and in view of aforesaid consent of both<\/p>\n
the parties, both for dissolution of marriage by a decree<\/p>\n
of divorce and for permanent alimony this Miscellaneous<\/p>\n
Appeal is finally disposed of. The order under appeal<\/p>\n
refusing to grant divorce is set aside and is replaced by a
\n                            3<\/span><\/p>\n
        decree for dissolution of marriage between the appellant<\/p>\n
        and respondent by mutual consent.\n<\/p>\n
                  In the facts of the case, the complaint case<\/p>\n
        lodged by the respondent bearing no. 913(c)\/2001 said to<\/p>\n
        be pending in the court of a Judicial Magistrate 1st Class,<\/p>\n
        Patna shall be compromised, withdrawn or abandoned<\/p>\n
        within the aforesaid period of six months. Since the son<\/p>\n
        of respondent is aged about 12 years, we expect the<\/p>\n
        respondent to keep aside a reasonable part of the alimony<\/p>\n
        for studies of her son.\n<\/p>\n
                  It is made clear that in case the terms of<\/p>\n
        compromise, particularly, relating to payment of the<\/p>\n
        amount of Rs. 12.5 lacs within the time frame are not<\/p>\n
        followed then either of the party will be at liberty to<\/p>\n
        move this court for appropriate orders.<\/p>\n
                  The appeal is, thus, finally disposed of. No<\/p>\n
        costs.<\/p>\n
