In\u00a0this\u00a0case,\u00a0the\u00a0Appellant\u00a0had,\u00a0in\u00a0his\u00a0application\u00a0dated\u00a031\u00a0May\u00a02009,\u00a0<\/p>\n<p>requested \u00a0 the \u00a0 CPIO \u00a0 to \u00a0 explain \u00a0 the \u00a0 procedure \u00a0 for \u00a0 selling \u00a0 or \u00a0 auctioning\u00a0<\/p>\n<p>mortgaged\u00a0 house\u00a0 property\u00a0 for\u00a0 recovery\u00a0 of\u00a0 loan.\u00a0 In\u00a0 his\u00a0 reply\u00a0 dated\u00a0 22\u00a0 June\u00a0<\/p>\n<p>2009,\u00a0the\u00a0CPIO\u00a0 explained\u00a0 that\u00a0 the\u00a0 procedures\/rules\u00a0 followed\u00a0 in\u00a0 such\u00a0 cases\u00a0<\/p>\n<p>were\u00a0the\u00a0same\u00a0as\u00a0mentioned\u00a0in\u00a0the\u00a0Civil\u00a0Procedure\u00a0Code\u00a0and\u00a0the\u00a0SARFESI\u00a0<\/p>\n<p>Act.\u00a0Not\u00a0satisfied\u00a0with\u00a0this\u00a0reply,\u00a0he\u00a0preferred\u00a0an\u00a0appeal\u00a0on\u00a07\u00a0July\u00a02009.\u00a0The\u00a0<\/p>\n<p>Appellate\u00a0Authority\u00a0disposed\u00a0of\u00a0the\u00a0appeal\u00a0in\u00a0his\u00a0order\u00a0dated\u00a08\u00a0August\u00a02009\u00a0in\u00a0<\/p>\n<p>which\u00a0he\u00a0endorsed\u00a0the\u00a0order\u00a0of\u00a0the\u00a0CPIO.\u00a0Now,\u00a0the\u00a0Appellant\u00a0has\u00a0approached\u00a0<\/p>\n<p>the\u00a0CIC\u00a0in\u00a0second\u00a0appeal.\n<\/p>\n<p>CIC\/SM\/A\/2009\/001619\n<\/p>\n<p> 3.      We\u00a0heard\u00a0this\u00a0case\u00a0through\u00a0videoconferencing.\u00a0The\u00a0Appellant\u00a0was\u00a0not\u00a0<\/p>\n<p>present\u00a0in\u00a0spite\u00a0of\u00a0notice.\u00a0The\u00a0Respondent\u00a0was\u00a0present\u00a0in\u00a0our\u00a0chamber.\u00a0We\u00a0<\/p>\n<p>heard\u00a0his\u00a0submissions.\u00a0We\u00a0find\u00a0that\u00a0the\u00a0CPIO\u00a0could\u00a0have\u00a0sent\u00a0copies\u00a0of\u00a0the\u00a0<\/p>\n<p>relevant\u00a0circulars\/guidelines\/instructions\u00a0of\u00a0the\u00a0bank\u00a0regarding\u00a0the\u00a0procedure\u00a0to\u00a0<\/p>\n<p>be\u00a0followed\u00a0when\u00a0a\u00a0mortgaged\u00a0house\u00a0property\u00a0for\u00a0recovery\u00a0of\u00a0a\u00a0housing\u00a0loan\u00a0<\/p>\n<p>has \u00a0 to \u00a0 be \u00a0 sold\/auctioned. \u00a0 Therefore,\u00a0 we \u00a0 direct \u00a0 the \u00a0 CPIO \u00a0 to \u00a0 forward \u00a0 to \u00a0 the\u00a0<\/p>\n<p>Appellant\u00a0within\u00a010\u00a0working\u00a0days\u00a0from\u00a0the\u00a0receipt\u00a0of\u00a0this\u00a0order,\u00a0the\u00a0copy\u00a0of\u00a0any\u00a0<\/p>\n<p>circular\/guideline\/instruction\u00a0which\u00a0lays\u00a0down\u00a0the\u00a0formalities\u00a0and\u00a0the\u00a0procedures\u00a0<\/p>\n<p>to\u00a0be\u00a0adopted\u00a0while\u00a0selling\/auctioning\u00a0such\u00a0a\u00a0house\u00a0property\u00a0in\u00a0the\u00a0process\u00a0of\u00a0<\/p>\n<p>recovery\u00a0of\u00a0housing\u00a0loan.\n<\/p>\n<\/p>\n<p>4.      The\u00a0case\u00a0is,\u00a0thus,\u00a0disposed\u00a0off.\n<\/p>\n<\/p>\n<p>5.
