It was contended for the latter  that\t de-\nscribing  Respondent  No.  1 as Deputy\tPrime  Minister\t was\ndescriptive and for all purposes he was a Minister, that the\nform  of oath prescribed in the Third Schedule\tpursuant  to\nthe requirement of Article 75(4) of the Constitution is only\nfor a Minister of the Union, and that there was no  separate\nform even for the Prime Minister.\n    It\twas  further submitted that the prescribed  oath  is\nsusceptible  of\t division into two  parts,  descriptive\t and\nsubstantial, and as long as the substantial part is properly\nfollowed, as in the instant case, a mere mistake or error in\nthe descriptive part would not vitiate the oath.\nDismissing the writ petition,\n    HELD:  Respondent  No. 1 is just a Minister\t like  other\nMembers\t of  the  Council of Ministers though  he  has\tbeen\ndescribed  as Deputy Prime Minister. The description of\t him\nas Deputy Prime Minister does not confer on him any power of\nPrime Minister. It cannot, therefore, be said that the\toath\nadministered  to  him as Deputy Prime Minister was  not\t the\noath\nin  accordance\twith the prescription of  the  Constitution.\n[3E, 2D]\n\n\n\nJUDGMENT:\n<\/pre>\n<p>ORIGINAL JURISDICTION: Writ Petition (C) No. 1269 of<br \/>\n1989.\n<\/p>\n<p><span class=\"hidden_text\">2<\/span><\/p>\n<p>    (Under Article 32 of the Constitution of India).<br \/>\n    K.M. Sharma petitioner-in-person.\n<\/p>\n<p>    Soli  J.  Sorabjee,\t Attorney  General,  Santosh  Hegde,<br \/>\nAdditional Solicitor General, A.K. Sen, Manbir Singh, Girish<br \/>\nChandra and Ms. A. Subhashini for the Respondents.<br \/>\n   The Court delivered the following order:\n<\/p>\n<p>\t\t      ORDER<br \/>\n    Two\t contentions were raised by the petitioner  in\tthis<br \/>\nwrit petition challenging the appointment of Respondent\t No.<br \/>\n1, Shri Devi Lal as Deputy Prime Minister of India:\n<\/p>\n<p>   (i)\tthat  the oath administered to him as  Deputy  Prime<br \/>\nMinister  was not the oath in accordance with the  prescrip-<br \/>\ntion of the Constitution; and\n<\/p>\n<p>   (ii)\t he was still functioning as the Chief\tMinister  of<br \/>\nHaryana\t when the oath of office of his new  assignment\t was<br \/>\nadministered to him.\n<\/p>\n<p>    Pursuant to notice, two affidavits have been  filed&#8211;one<br \/>\nby the Respondent No. 1 and the other on behalf of the Union<br \/>\nof  India.  In\tthe affidavit of Respondent  No.  1  certain<br \/>\nprecedents have been relied upon and the practice which\t has<br \/>\nbeen followed eversince the Constitution came into force has<br \/>\nbeen referred to.\n<\/p>\n<p>    Learned  Attorney  General appearing on  behalf  of\t the<br \/>\nUnion  of India has stated that the form prescribed  in\t the<br \/>\nThird Schedule pursuant to the requirement of Article  75(4)<br \/>\nof the Constitution is only for a Minister of the Union\t and<br \/>\nthere is no separate form even for the Prime Minister. Since<br \/>\nthe Prime Minister is also a member of the Council of Minis-<br \/>\nters,  he  takes the same oath as the  other  ministers\t are<br \/>\nrequired to take. He maintains that yet in view of the\tfact<br \/>\nthat  the Constitution describes him as the Prime  Minister,<br \/>\nwhile being sworn into office, he describes himself as Prime<br \/>\nMinister and this practice is in  vogue eversince 1950.\t The<br \/>\noath  register is by the incumbent signed as Prime  Minister<br \/>\nand all other ministers sign as Ministers. He further  indi-<br \/>\ncates that describing Shri Devi Lal as Deputy Prime Minister<br \/>\nis  descriptive only and for all purposes he is\t a  Minister<br \/>\nand there is no<br \/>\n<span class=\"hidden_text\">3<\/span><br \/>\nconstitutional sanction for the post of Deputy Prime  Minis-<br \/>\nter as such.\n<\/p>\n<p>    Relying on a bench decision of this Court in the case of<br \/>\n<a href=\"\/doc\/554549\/\">Virji Ram Sutaria v. Nathalal Premji Bhavadia &amp; Ors.,<\/a> [1969]<br \/>\n2  SCR 627, learned Attorney General further  contends\tthat<br \/>\nthe  prescribed oath should be divided into two\t parts,\t one<br \/>\nwhich  is descriptive and the other which contains the\tsub-<br \/>\nstantial  part.\t And  according\t to  him,  as  long  as\t the<br \/>\nsubstantial  part  is properly followed, a mere\t mistake  or<br \/>\nerror in the &#8211;descriptive part would not vitiate the oath.<br \/>\nThis Court in the reported decision said:<br \/>\n&#8220;In  this  case,  as we have already  noted,  the  essential<br \/>\nrequirement of Article 173 read with Form VII-A was that the<br \/>\nperson taking the oath or making the affirmation would\tbear<br \/>\ntrue faith and allegiance to the Constitution and uphold the<br \/>\nsovereignty and integrity of India. The words which  precede<br \/>\nthis portion are merely descriptive of the person and of his<br \/>\nnomination as a candidate.&#8221;\n<\/p>\n<p>    In\tview  of the clear statement. made  by\tthe  learned<br \/>\nAttorney  General that Respondent No. 1 is just\t a  Minister<br \/>\nlike other members of the Council of Ministers though he has<br \/>\nbeen described as Deputy Prime Minister but the\t description<br \/>\nof  him as Deputy Prime Minister does not confer on him\t any<br \/>\npowers\tof the Prime Minister, along with his other  submis-<br \/>\nsions, we think the first contention raised by the petition-<br \/>\ner  has\t no force. So far as the second contention  is\tcon-<br \/>\ncerned, the petitioner himself does not press it.<br \/>\n    We accordingly reject the writ petition for the  reasons<br \/>\nindicated above.
