No. 1147 OF 2010\n          ----------------------------------------\n               Dated 17th Day of May, 2010\n\n                          ORDER\n<\/pre>\n<p>      This Crl.Revision Petition is preferred by the accused<\/p>\n<p>in a prosecution for the offence punishable under section<\/p>\n<p>138 of the Negotiable Instruments Act.<\/p>\n<p>      2.   The allegation against the accused\/revision<\/p>\n<p>petitioner is that he     had     borrowed an amount of<\/p>\n<p>Rs.35,000\/- from the complainant one Devarajan, who is<\/p>\n<p>no more and in discharge of such liability, the revision<\/p>\n<p>petitioner issued a cheque for Rs.35,000\/- which when<\/p>\n<p>presented for encashment        was dishonoured,      hence<\/p>\n<p>instituted the above complaint.            During the trial,<\/p>\n<p>Maniyamma Devarajan, wife of the said Devarajan was<\/p>\n<p>examined as PW1 who was          prosecuting the complaint<\/p>\n<p>and produced Exts.P1 to P6 documents.          From the side<\/p>\n<p>of the accused,     himself was examined       as DW1 and<\/p>\n<p>marked Exts.D1 and D2. The trial court found that the<\/p>\n<p>revision petitioner\/accused is guilty under section 138 of<\/p>\n<p>CRL.R.P. No.1147\/2010<br \/>\n<span class=\"hidden_text\">                                -:2:-<\/span><\/p>\n<p>the Act and accordingly, convicted and sentenced him to<\/p>\n<p>undergo simple imprisonment for 3 months and to pay a<\/p>\n<p>fine of Rs.35,000\/- and the default sentence is fixed as<\/p>\n<p>simple imprisonment for three months.<\/p>\n<p>     3. Both the conviction and sentence were challenged<\/p>\n<p>by the revision petitioner by filing Crl.A.No.113\/2009 and<\/p>\n<p>by judgment dated 25.11.2009, the Sessions Court partly<\/p>\n<p>allowed the appeal by confirming the conviction and the<\/p>\n<p>sentence was modified and he was directed to a pay only<\/p>\n<p>a fine of 35,000\/- and in default of payment of fine he<\/p>\n<p>was directed to undergo      simple imprisonment for three<\/p>\n<p>months.     It was also ordered that if the amount of fine<\/p>\n<p>is realised,   the same shall be paid to the legal heirs of<\/p>\n<p>the deceased complainant.\n<\/p>\n<p>     4. The        present   Crl.Revision Petition is filed<\/p>\n<p>challenging the judgments of the lower courts. There is no<\/p>\n<p>dispute   regarding    the  transaction   claimed  by  the<\/p>\n<p>complainant.      But according to the accused,    he had<\/p>\n<p>received    only Rs.15,000\/- from the husband of PW1<\/p>\n<p>CRL.R.P. No.1147\/2010<br \/>\n<span class=\"hidden_text\">                                   -:3:-<\/span><\/p>\n<p>and paid back Rs.10,000\/-. The Trial court as well as the<\/p>\n<p>lower appellate court has specifically found that though<\/p>\n<p>the    revision   petitioner\/accused     has   taken    such   a<\/p>\n<p>contention, to substantiate such contention, no evidence<\/p>\n<p>was adduced. The revision petitioner miserably failed to<\/p>\n<p>make out any case and to discredit the testimony of PW1.<\/p>\n<p>As the accused has         admitted the financial transaction,<\/p>\n<p>execution and the issuance of the cheque and when the<\/p>\n<p>courts below         have concurrently        found that the<\/p>\n<p>complainant      has succeeded        in establishing the case<\/p>\n<p>against the accused, I find no merit in the Crl.Revision<\/p>\n<p>Petition.\n<\/p>\n<p>       5. The learned counsel for the revision petitioner<\/p>\n<p>submitted that       breathing time may be granted to make<\/p>\n<p>the payment of the fine amount. Having regard to the facts<\/p>\n<p>and circumstances involved in the case, I am of the view that two<\/p>\n<p>months&#8217; time can be granted to the revision petitioner to deposit<\/p>\n<p>the fine amount.\n<\/p>\n<p>       In the result, this Crl. R.P is disposed of confirming the<\/p>\n<p>CRL.R.P. No.1147\/2010<br \/>\n<span class=\"hidden_text\">                                    -:4:-<\/span><\/p>\n<p>conviction recorded by both the courts below and confirming the<\/p>\n<p>sentence of fine awarded by the lower appellate court and the<\/p>\n<p>petitioner is further directed to deposit the fine amount within two<\/p>\n<p>months from today and if there is any default on the part of the<\/p>\n<p>petitioner in making the deposit, within the stipulated time, the trial<\/p>\n<p>court is free to take coercive steps for executing the sentence and<\/p>\n<p>realising the fine amount.\n<\/p>\n<p>       The Crl.R.P is disposed of accordingly.<\/p>\n<p>                                                   V.K.MOHANAN,<br \/>\n                                                       JUDGE<\/p>\n<p>kvm\/-\n<\/p>\n<p>CRL.R.P.
