Justice K.T.SANKARAN\n\n Dated :25\/03\/2010\n\n O R D E R\n                         K.T.SANKARAN, J.\n                   ---------------------------------------------\n                        B.A.No.1688 of 2010\n                   ---------------------------------------------\n               Dated this the 25th day of March, 2010\n\n\n                                O R D E R\n<\/pre>\n<p>       The petitioner apprehends arrest by the Cyber Cell,<\/p>\n<p>Thiruvananthapuram on an accusation of the petitioner having<\/p>\n<p>committed a non bailable offence under the Information<\/p>\n<p>Technology Act.\n<\/p>\n<p>      The learned Director General of Prosecution submitted that<\/p>\n<p>the offence alleged against the petitioner is under Section 66(A)<\/p>\n<p>(a)(b) of the Information Technology Act and as per Section 77B<\/p>\n<p>of the Act, the said offence is bailable.<\/p>\n<p>      Since the offence alleged against the petitioner is bailable,<\/p>\n<p>this application under Section 438 of the Code of Criminal<\/p>\n<p>Procedure is not maintainable.
