PATTANAIK\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t    WITH<br \/>\n\tSPECIAL LEAVE PETITION (C) NO. 23650 OF 1996<br \/>\n\t\t     [ CC  &#8211;  5886\/96 ]<br \/>\n\t\t\t O R D E R<br \/>\n     SLP (C) NO.21792\/96:\n<\/p>\n<p>     The grievance  in this  special leave  petition,  filed<br \/>\nagainst the  order of  the Division Bench of the Kerala High<br \/>\nCourt, made  on July  2,  1996\tin  CMP\t No.31034\/95  in  OP<br \/>\nNo.10608\/93, is two-fold, namely the direction to sanction a<br \/>\nsum  of\t  Rs.7,10,212\/-\t incurred   by\tone  Shri  Raghavan,<br \/>\nAdministrator and  the direction to pay a sum of Rs.35,000\/-<br \/>\nbeing monetary\tconsideration for  the work done by Raghavan<br \/>\nas Administrator in conducting the examinations.\n<\/p>\n<p>     Shri Y.R.\tReddy, learned Additional Solicitor General.<br \/>\ncontended that\tthe amount  of Rs.7,10,212\/-  spent by\tShri<br \/>\nRaghavan in  connection\t with  conducting  the\texaminations<br \/>\nwould be  dealt with  in accordance  with the administrative<br \/>\nprocedure prescribed  by  the  Dewaswom\t Committee  in\tthat<br \/>\nbehalf and  the direction  for sanction would run counter to<br \/>\nthe administrative  procedure prescribed  in that behalf and<br \/>\nit will create unnecessary complications in scrutinising the<br \/>\naccounts and  passing the  bills towards the amount spent by<br \/>\nShri Raghavan. It is also assured by Shri V.R. Reddy that if<br \/>\nthe expenditure\t has  been  spent  in  accordance  with\t the<br \/>\nrequirements and  principles, the same will be sanctioned by<br \/>\nthe competent  authority in that behalf. We need not deal in<br \/>\nthat  behalf  at  length.  Suffice  it\tto  state  that\t the<br \/>\nauthority competent  to scrutinise the amount spent would go<br \/>\ninto the  matter and pass appropriate orders sanctioning the<br \/>\namount\tspent\tby  the\t  Administrator\t in  conducting\t the<br \/>\nexaminations.\n<\/p>\n<p>     With regard to the second aspect, namely, the direction<br \/>\nto pay\tmonetary  consideration\t in  a\tsum  of\t Rs.35,000\/-<br \/>\ntowards the exemplary work done by Raghvan, we feel that the<br \/>\nHigh Court,  Perhaps found it necessary to direct payment of<br \/>\nthe said amount in addition to commendation of the work done<br \/>\nby  Raghavan.\tIt  being   a  discretion  exercised  in  an<br \/>\nextraordinary situation\t perhaps,  we  may  not\t incline  to<br \/>\ninterfere with\tthe direction.\tBut we make it clear that it<br \/>\nwould not  be treated  as a precedent in every case wherever<br \/>\nan officer  on deputation does the work at the directions of<br \/>\nthe  Court;   he  would\t  also\tbe   entitled  to   monetary<br \/>\nconsiderations in  addition to\tthe normal  service and\t the<br \/>\nsalary\treceived  for  doing  that  service.  We  take\tthis<br \/>\ndecision for  the reason  that perhaps\tthe officer  did not<br \/>\nbargain for  such direction  for payment  in  rendering\t the<br \/>\nservice and  any notice to him would put him in embarrassing<br \/>\nsituation and  the Court  also will  not be in a position to<br \/>\nsay anything  when  the\t matter\t goes  on  notice.  In\tthis<br \/>\nsituation  we\tare  not  inclined  to\tinterfere  with\t the<br \/>\ndirection issued  by the Division Bench of the High Court in<br \/>\nthis behalf.\n<\/p>\n<p>     The petition  is accordingly  ordered  with  the  above<br \/>\nobservations.\n<\/p>\n<p>     IN SLP (C) NO. \/93 (CC-5886\/96 ):\n<\/p>\n<p>     Permission to file special leave petition is granted.<br \/>\n     In this  matter, the  petitioner is  aggrieved  of\t the<br \/>\nobservations made  by the  Division Bench  in the  aforesaid<br \/>\norder. The  petitioner states  that this Court in <a href=\"\/doc\/107366\/\">Guruvayoor<br \/>\nDevaswom  Managing   Committee\tvs.   Chairman,\t  Guruvayoor<br \/>\nDevaswom Managing  Committee &amp; Ors.<\/a> [ (1996) 7 SCC 505 ] has<br \/>\nupheld the  action taken  by the  petitioner and, therefore,<br \/>\nthe observations made were not justified or warranted. Those<br \/>\nobservations came  to be  made without\tany notice to him or<br \/>\nhearing him.  We need  not pursue the matter at this end. It<br \/>\nwould be  open to  the petitioner  to make an application in<br \/>\nthe High  Court to  expunge the\t remarks and  the High Court<br \/>\nwould deal with it accordingly.\n<\/p>\n<p>     The petition  is accordingly  dismissed with  the above<br \/>\nliberty.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India State Of Kerala Etc vs Guruvayur Devaswom Managing &#8230; on 18 November, 1996 Bench: K.
