Justice T.R.RAMACHANDRAN NAIR\n\n Dated :26\/03\/2009\n\n O R D E R\n               T.R.RAMACHANDRAN NAIR,J.\n                      -------------------------\n                  W.P ( C) No.9760 of 2009\n                      --------------------------\n              Dated this the 26th March,2009\n\n                        J U D G M E N T\n<\/pre>\n<p>      The petitioner, while working as Deputy Tahasildar,<\/p>\n<p>retired from service on 31.10.2003. But still the DCRG<\/p>\n<p>has not been disbursed to him.\n<\/p>\n<\/p>\n<p>      2.   Before retirement, he was suspended from<\/p>\n<p>service on the allegation of issuance of a solvency<\/p>\n<p>certificate. He was issued with memo of charges and later<\/p>\n<p>was reinstated in service. Exhibit-P1 is the copy of the<\/p>\n<p>charge memo to which the petitioner has submitted<\/p>\n<p>Exhibit-P2<\/p>\n<p>      3.   Some other officers including Village Officers<\/p>\n<p>and Tahsildars were also suspended from service and they<\/p>\n<p>have    also  been   subjected      to    disciplinary action.<\/p>\n<p>Ultimately the disciplinary action against the similarly<\/p>\n<p>placed persons were dropped and it is pointed out that the<\/p>\n<p>concerned Tahasildar has already received the entire<\/p>\n<p>DCRG,.       This is evidenced by Exhibit-P3 dated<\/p>\n<p>W.P ( C) No.9760 of 2009<br \/>\n<span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>15.11.2005 . The only role of the petitioner was to forward<\/p>\n<p>the report of the Village Officers for issuance of solvency<\/p>\n<p>certificates to the Tahasildar. It is submitted that no loss<\/p>\n<p>has been caused to the Government in the matter.<\/p>\n<p>      3.   Repeated representations have been submitted<\/p>\n<p>by the petitioner seeking to disburse the DCRG and other<\/p>\n<p>benefits . Earlier he had approached this Court by filing<\/p>\n<p>WPC No. 12149 of 2007 and pursuant to the directions<\/p>\n<p>issued in Exhibit-P5 judgment dated 18.12.2007, the 5th<\/p>\n<p>respondent issued       an order directing to release the<\/p>\n<p>pensionary benefits to the petitioner including the DCRG.<\/p>\n<p>But only the DCRG at a lower rate was paid to the<\/p>\n<p>petitioner and other pensionary benefits were not paid to<\/p>\n<p>him.    In these circumstances, he has filed      a detailed<\/p>\n<p>representation as per Exhibit-P6 before the 1st respondent<\/p>\n<p>requesting to sanction and regularize       the suspension<\/p>\n<p>period as duty and disburse to him the amount on account<\/p>\n<p>of terminal benefits, leave surrender, arrears of increment,<\/p>\n<p>pay, pension, DCRG and Commuted Value of Pension etc.<\/p>\n<p>      4.   Petitioner   seeks   for   a  direction  to  the<\/p>\n<p>W.P ( C) No.9760 of 2009<br \/>\n<span class=\"hidden_text\">                               3<\/span><\/p>\n<p>Government to take a decision on Exhibit-P6 within a time<\/p>\n<p>frame.\n<\/p>\n<p>     5.
