SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 08\/02\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>\tPresent<br \/>\n\tapplication, under<br \/>\n\tSection  5  of<br \/>\n\tthe Limitation Act,  has been preferred by the applicant &#8211;<br \/>\n\toriginal appellant \/ claimant  for condonation of delay of 419 days<br \/>\n\tcaused in preferring the First Appeal challenging the  Judgement and<br \/>\n\tAward passed by the\u00a0learned Motor Accident Claims Tribunal<br \/>\n\t(Auxiliary), 3rd Additional District Judge, Kheda at<br \/>\n\tNadiad in Motor Accident Claim Petition No. 1874 of 1995<br \/>\n\tdtd.4\/4\/2009, in so far as not awarding full claim as prayed for.\n<\/p>\n<p>\tThough<br \/>\n\tserved nobody appears on behalf of the respondents and hence there<br \/>\n\tis no opposition to the present application.\n<\/p>\n<p>\tHaving<br \/>\n\theard the learned advocate appearing on behalf of the applicant and<br \/>\n\tconsidering the averments made in the application  in support of the<br \/>\n\t prayer to condone the delay and so as to give one\u00a0additional<br \/>\n\topportunity to the applicant  to submit the case on merit rather<br \/>\n\tthan non-suiting the applicant on the technical ground of delay and<br \/>\n\tlaches, present application is allowed. The delay caused in<br \/>\n\tpreferring the First Appeal  is hereby condoned. Rule is made<br \/>\n\tabsolute accordingly.
