Dishari, District- Vaishali --- Petitioner.\n                                              Versus\n                                    THE STATE OF BIHAR\n                                            -----------\n<\/pre>\n<p>2\/   19-01-2011              Heard the parties.\n<\/p>\n<p>                             The present petition has been filed on behalf of<\/p>\n<p>                   the   petitioner    seeking   modification   of   order    dated<\/p>\n<p>                   27.10.2010 passed in Cr. Misc. No. 24400 of 2010 whereby<\/p>\n<p>                   the petitioner was granted bail in connection with Sessions<\/p>\n<p>                   Trial No. 727 of 2007, arising out of Gardanibagh P.S. Case<\/p>\n<p>                   No. 138 of 2006, subject to certain conditions. One of the<\/p>\n<p>                   conditions was that one of the bailors must be a<\/p>\n<p>                   government servant. Learned counsel for the petitioner<\/p>\n<p>                   submits that though the order was passed as far back as<\/p>\n<p>                   on 27.10.2010 and the petitioner is in judicial custody<\/p>\n<p>                   since 10.02.2006, but he has not been able to arrange any<\/p>\n<p>                   government servant to stand as his bailor. He submits that<\/p>\n<p>                   if that condition is not deleted\/ modified, then the order<\/p>\n<p>                   granting bail shall become infructuous.<\/p>\n<p>                             For      the   reasons   stated    in   the     present<\/p>\n<p>                   modification petition, the order dated 27.10.2010 passed<\/p>\n<p>                   in Cr. Misc. No. 24400 of 2010 is modified to the extent<\/p>\n<p>                   that out of two bailors, one of the bailors must be a family<\/p>\n<p>                   member or close relative of the petitioner. Government<\/p>\n<p>                   servant is not required to be made as a bailor and that<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>           condition is waived herein.\n<\/p>\n<p>                     With the aforesaid observation\/direction, the<\/p>\n<p>           present modification petition is allowed and the order<\/p>\n<p>           dated 27.10.2010 stands modified, to the extent indicated<\/p>\n<p>           above.\n<\/p>\n<p>                     Let the above named petitioner be released on<\/p>\n<p>           bail in terms of the aforesaid order dated 27.10.2010 on<\/p>\n<p>           fulfillment of other conditions indicated in that order,<\/p>\n<p>           excepting the condition-A of that order.<\/p>\n<p>                     Let this order be communicated to the court<\/p>\n<p>           below through fax at the cost of the petitioner.<\/p>\n<p>                                 ( Birendra Prasad Verma, J.)<br \/>\nBTiwary\/\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Md.
