The  learned   counsel  for  the  5th<\/p>\n<p>respondent states that the entrustment of the<\/p>\n<p>portion of the building claimed by the petitioner<\/p>\n<p>to him as a tenant is admitted, though the case<\/p>\n<p>of respondents 5 and 6 is that the petitioner had<\/p>\n<p>vacated the premises but was authorised to keep<\/p>\n<p>his utensils in one or two rooms. We are clear in<\/p>\n<p>our mind that this is not a dispute to be<\/p>\n<p>resolved through the writ court. Evidently, this<\/p>\n<p>was the reason that this Court had restricted the<\/p>\n<p>interim order granted on 8.9.2010 to be one for<\/p>\n<p>life of the petitioner and his workers as against<\/p>\n<p>any threat from respondents 5 and 6. That does<\/p>\n<p><span class=\"hidden_text\">WPC27894\/10           -: 2 :-<\/span><\/p>\n<p> not mean that the police can, under the cover of<\/p>\n<p> that order, change the actual fact situation<\/p>\n<p> which may be available. Therefore, we order that<\/p>\n<p> the police will continue to ensure that the<\/p>\n<p> petitioner and any of his workers are provided<\/p>\n<p> adequate protection, however that, the police<\/p>\n<p> will not insist on them being permitted to carry<\/p>\n<p> on any particular activity in the building in<\/p>\n<p> question.   We clarify that either of the parties<\/p>\n<p> will be at liberty to move the competent court<\/p>\n<p> and obtain appropriate orders or even to get<\/p>\n<p> further relief in the matter in which Ext.P4<\/p>\n<p> order has been issued. We leave open all other<\/p>\n<p> questions.
