DENESAN, J.\n\n\n\n                = = = = = = = = = = = = = = =\n\n                 W.P.(C) No. 6638 OF 2007 R\n\n                = = = = = = = = = = = = = = =\n\n\n\n               Dated this the 14th March, 2007\n\n\n\n                         J U D G M E N T\n<\/pre>\n<p>     The   petitioner   commenced   service   on   7-9-2001   as<\/p>\n<p>Part-time Sweeper in the High Court of Kerala.  She was<\/p>\n<p>appointed as Peon and has been working as such from 28-\n<\/p>\n<p>2-2005.   She has made a claim for the grant of special<\/p>\n<p>allowance   at   the   rate   of   Rs.200\/-   per   mensem   with<\/p>\n<p>effect   from   1-11-1998.     It   is   admitted   position   that<\/p>\n<p>the   special   allowance   is   payable   only   to   those<\/p>\n<p>performing   duties   in   the   residence   of   the   Hon&#8217;ble<\/p>\n<p>Judges of the High Court of Kerala.\n<\/p>\n<p>     2.   Heard   the   learned   counsel   for   the   petitioner,<\/p>\n<p>learned Senior Govt. Pleader for the 1st  respondent and<\/p>\n<p>the learned Senior counsel for the 2nd respondent.\n<\/p>\n<p>     3.   It   is   submitted   on  behalf   of   the   2nd  respondent<\/p>\n<p>that   the   petitioner   had   worked   as   Part-time   contingent<\/p>\n<p>employee in the residence of two Hon&#8217;ble Judges for the<\/p>\n<p>period   from  6-1-2001  to  31-1-2001  and  from  7-9-2001  to<\/p>\n<p>27-2-2005   respectively.   Hence,   the   only   question   for<\/p>\n<p><span class=\"hidden_text\">W.P.(C)No. 6638\/2007                                           :2:<\/span><\/p>\n<p>consideration   is   whether   the   petitioner   is   entitled   to<\/p>\n<p>claim special allowance for the above period.\n<\/p>\n<p>        4.   According   to   the   1st                       respondent,   special<\/p>\n<p>allowance at the rate of Rs.200\/- need be granted from<\/p>\n<p>the date of G.O.(MS) No. 147\/2005\/Home dated 27-5-2005,<\/p>\n<p>for,   grant   of   special   allowance   with   effect   from   any<\/p>\n<p>date   prior   to   the   date   of   the   above   Govt.   Order   will<\/p>\n<p>violate   Article  49  of  the  Kerala  Financial  Code  Volume<\/p>\n<p>I.\n<\/p>\n<p>        5.   Counsel   for   the   petitioner   as   also   the   Senior<\/p>\n<p>counsel   for   the   2nd  respondent   invite   my   attention   to<\/p>\n<p>Ext. P3 judgment dated 7-2-2007 in W.P.(C) No. 18328\/06<\/p>\n<p>and submit that the above judgment is covered in favour<\/p>\n<p>of   the   petitioner.                   I   have   gone   through   Ext.   P3<\/p>\n<p>judgment   and   find   that   the   above   submission   is<\/p>\n<p>acceptable.     Accordingly,   there   shall   be   a   declaration<\/p>\n<p>that   the   petitioner   is   entitled   for   the   grant   of<\/p>\n<p>special allowance at the rate of Rs.200\/- per month for<\/p>\n<p>service   rendered   as   Part-time   contingent   employee<\/p>\n<p>performing     duties   as   such   in   the   residence   of   the<\/p>\n<p>Hon&#8217;ble   Judges   from     6-1-2001     to   31-1-2001     and   from<\/p>\n<p>7-9-2001   to  27-2-2005.        Monetary  benefits  consequent<\/p>\n<p><span class=\"hidden_text\">W.P.(C)No. 6638\/2007                                           :3:<\/span><\/p>\n<p>on the above declaration shall be made available to the<\/p>\n<p>petitioner, as expeditiously as possible, in any event,<\/p>\n<p>within three months from the date of receipt of a copy<\/p>\n<p>of the judgment.\n<\/p>\n<p>                                                                        K.K.
